2 year GC vs. 10 year GC

i probably made no sense in asking that, sorry. If you do not get the interview for AOS in the 2 years of marriage, you get 10 year green card right?

 Potentially having to renew your EAD, you might not be covered with the EAD and loose your authorization and not be able to work? My thinking is: as long as your EAD covers you during those 2 years or whenever your interview is after the 2 years of marriage....is this situation better than having a 2 year GC. 

 

1) EAD -----> 2years wait ----->NO ROC and GC for 10 years

 

or

 

2)EAD---->2year GC----->ROC----->10 year GC

10/17/2018                After 136 days of wait in HELL, finally EAD in production

10/21/2018                Card was mailed to me, and yes it said so on a Sunday night, while Vj-ing

10/22/2018                Card was picked up by the USPS

10/24/2018                EAD in hand. F%^&& finally

12/28/2018                Interview has been scheduled. Waiting for notification with date by snail mail

Oh I see. If the interview happens to fall after your 2-year marriage anniversary, then yes you get the 10 year GC. We don't have any control over when the interview happens though. So the only thing we can do is file the EAD renewal far enough ahead of time to ensure it is approved and the new card is sent to us before the old one actually expires. I believe (gotta double-check...haven't looked too in-depth into EAD renewal yet) that you also receive a receipt notice that acts as an "EAD extension" for 180 days past your original EAD's expiration in case you do not receive the second physical card before the original card's expiration. Similar to the extension letter you get after filing I-751. So unless there is some terrible problem or delay, your original EAD and the renewal (if needed) should cover you without any "dead time" in which you lose authorization to work.

Also, I called customer service and asked them about that and they said that is not possible. But, again, I wouldn’t be surprised to be given wrong information from USCIS.

Not correct.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
