I sponsored my ex in 2017 (1st NOA 01/30/2017, K-1 issued 07/12/2017) but we broke up and she never used her visa. On May 6, 2018, I met this amazing woman while on vacation in Manila and I knew she's the one. I decided to surprise her on her birthday on July 16, 2018 by visiting her again in Manila and I know it sounds crazy but I proposed to her when we went to Thailand, and she said yes. Now here are my questions:

 

1. Do you think my application to sponsor her will be scrutinized (and worst, denied) since we've known each other for only two months? I have been to Manila twice in 2 months but would this raise suspicions? I don't want to be in a long-distance relationship that's why I'm doing this, and we are both in our 30's and want to start a family asap.

 

2. I honestly don't want to wait and I know I have to request a waiver for this application, but if I decide to wait a bit, when does the two-year filing limitation end? Is it 2 years after 01/30/2017 when I filed the petition or 07/12/2017 when the visa was issued? 

 

3. Both of us bear the same last name and I don't know if this is an issue (we are both Filipinos and our last name is pretty common). Should we submit an evidence to prove we are not related?

1. Yes. Your case will be questioned. Denied? Who knows? They will definitely want to know how come your changing fiances so fast. 

 

2. Never heard of this. 

 

3. Probably not. 

 

By the way. Make sure your current girlfriend is aware about your previous girlfriend. She'll definitely be asked about it.

I doubt anything will be mentioned during the K1 interview in Manila.  Seems as if they really don't care about past K1's there.

DONE FOR TWO YEARS!!! ;)

 

Filed everything ourselves with no RFE's or delays.

 

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/4/20     Mailed packet

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

You will need a waiver.  Very easy to do yourself a short sentence asking for a waiver, I did one and found the wording here on VJ.

Thanks man. I’m just worried coz I met her just 2 months ago and now I’m sponsoring her for a fiancé visa. But I know there are people here who’ve met once and they sponsor their fiancés right away and they get approved. I’m sending her paperwork tomorrow.

The K1 and CR1 (Marriage Visa) are taking about the same time to get processed last I checked.

 

You may want to look into getting married in Philippines, No waiver needed plus it cheaper in the long run.   Something to think about and consider.

Just to clarify about the waiver YES you will need to submit a waiver. If you have 2 or more petitions OR if you have an approved petition in the 2 year window (from the date of your NOA1). I know this cuz I just got an RFE yesterday and they explained this policy and what information they need in detail. My first petiton was with my ex in 2016. He failed in both our relationship and interview and things just went downhill from there. I met my fiance now months after that and here we are :)

 

Don't feel too scared about the timeline of your new relationship. I've known people who met only weeks from their last one and they filed. Just make sure you have strong supporting evidence and be prepared in case they ask you about your previous file and what makes this one different from your last.

  • Met in Person - September 25, 2017 (Surprised him for his birthday)
  • Got Engaged! - September 28, 2017 ♥

1, My wife and I, after our 1st face to face, got engaged and we filed about 2 months after our first meeting. 

 

3:,  Yes, I think you should have proof.  Reminds me of a woman from the Philippines, when asked why she was not looking for a Filipino man, and she said "Everyone is relates here in one way or another.. many cousins, but I can see where some CO "might ask".. best to have the info and not need it, than to need it and not have it, right?

Not only that but she will be able to work and travel after entering the US without the AOS. The most knowledgeable ones on VJ have agreed that tbe CR1 is superior to the K1 unless she is comfortable with being a housewife unable to visit her family for several months. Every situation is different and I truly wish you both all the best. Congratulations!

I really appreciate all your input!

 

The reason I don’t want to do the CR1 is because she aged out when her mom’s petition (by her grandma) got approved, so her entire family but her is here. And my family is here, so it makes sense to get married here than there. 3 hours of FaceTime every night and multiple texts everyday aren’t enough, and it is expensive to visit her every 2-3 months, which I plan to do while the K-1 application is pending.

That might raise some eyebrows.

You want my advice? Wait few more month before filling the petition. Maybe a year. Visit her a lot. Get to know her before you commit to marriage. Honestly? It might as well be a scam so she can join her family in the US faster rather than waiting years for another family petition. 

 

How long did you know your first fiance before applying? Why are you in such a desperate rush? Give yourself time to know someone... knowing someone for 2 months isn't good enough to really know that person and be sure 100% you want to marry them.
