Do i need annullment before remarrying

Hi, 

im a usa citizen and got married in the philippines in 2009. Husband came to the usa, and he got his usa citizenship in 2014. Things didnt workout between us and we filed for divorce last yr 2017 and is finalized. I met someone in philippines and want to bring him here in the usa. Can i file for a fiAnce visa for him or do i still need to get my marriage annulled in philippines to do that?

As the matter of annulment in the Philippines is very specific and unique, I have moved this question to the Philippines forum. 

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

I believe that, since you have obtained a final divorce in the US, it means YOU are now free to marry and file the I-129F.

Registered Nurse- Retired- I practiced in the areas of Labor & Delivery, Home Health, Adolescent Psych, & Adult Psych.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I believe that if the US citizen receives a legal divorce in the US, he or she does not need to anull the marriage in PI.  Your divorce is determined by US law.

You are divorced .. thus you are free to marry anywhere in the world (except the Philippines).    

 

You are good to go to file the K-1  I-129F petition.  No need for an annulment..
