Hi, Im new here in this site, Im Chen from Philippine and married for 8yrs  to a foreign man from USA. We have two kids and both american citizen s. We lived here in the Philippines for many years now and we plan to move to USA. my husband work online as a teacher and it is a good income. My question s is does my husband can able to sponsor me with my two kids alone or still needed another member to sponsor? and because we married for 8yrs now does our paper works process quicker?

1.  Your husband will have to provide evidence that your family plans to live in the US.  That is called domicile.

2.  He will have to show sufficient income which will continue after he relocates back to the US, or he will have to find a sponsor.

3.  The length of time you have been married will NOT make the process faster.  The only advantage is that it will result in 10 year Green Cards, instead of 2 year green cards.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Your processing will not be faster because of the length of your marraige, but you will receive an unconditional Green Card on entry and not have to remove conditions as with a 2 yr Conditional Green Card. 

If your husband is able to show that his current employment source and income level will continue when he is in the US, his I 864 should be accepted . But it might be worth thinking who you might ask to be a joint sponsor if they request one.

Magandang gabi po or Good Evening Ma'am in English. What is your husband's salary and what does he plan on doing in the USA once you all arrive? Once you tell us that then we can let you know if he will need a cosponsor or not.

 

Since he is already in the Philippines as a resident then he can file for you using what is call Direct Consular Filing(DCF) which means he will file the petition at the US Embassy in Manila instead of having to send it to the USA to file it. This means that the wait time is decreased significantly to only a few months instead of almost a year now. He will be filing for what is called the IR1 visa for you, which means that you two have been married for longer than 2 years. That means that when you do get the US Green Card it will be a 10 year green card automatically instead of the 2 year Green Card.

Congrats on taking the first step - the decision to move to the US.

 

Like @missileman and others stated, your husband has to prove domicile and ensure his Affidavit of Support is 125% above the poverty line for 4 persons (you, him and your 2 kids) as per the Federal Poverty guidelines enacted for 2018. Just as a safety measure, have someone on standby as a 'backup' sponsor should they request one.

Being married for 8yrs allows you to bypass a conditional 2-yr spouse visa and you would not have to file to remove the conditions.
