Good day.. Just want to ask for your help po. My father was petitioned with f4 category,
PD - march 1995.
Visa become current - july 2018.
Age when petition was filed - 3,
Age today - 26
My cousins (who are older than me; 27yrs old) are derivative beneficiaries of my father's sister with same priority date as to him, but they were given a chance to pay for their IV fee even they were aged-out.. Does this mean that they will surely be issued an immigrant visa after the interview? Unfortunately, i didn't get any notification for me to also pay for my IV fee. I already send a message to the NVC but they said that i'm no longer eligible to be a derivative applicant.

What matters is the petition approval time in both cases. If you father’s sister’s case was approved a few years later than your father’s case, your cousins may not have aged out due to the CSPA age.

So how long did it take to be approved, would have needed to have been more than c 5 years.

If you give exact dates of:

- birthdays of the children

- petition priority date 

- petition approval date 

then we can figure it out properly

Paying the IV fees does not mean he will get the Visa. NVC issued the IV fees based on their calculation for CSPA.

However, at the interview, Consular Officer will decide if he is eligible for CSPA.

Some people got IL then they were denied due to CSPA age out.

 

If you don't have exact dates for approval dates, priority dates and birthdates of your case and his case, we cannot give you a correct answer.

A month?! Some kind of record. IF that’s correct (I’m not sure it is) then you are all aged out years ago. If it’s a month then there is practically no difference between your real age and your CSPA age.

I’d suggest you double check the date of the appprval notice. Was uscis really so much more efficient back then?

So many variables in the game. Unless you can confidently confirm to the following three things (not that you know of, but that you have seen on paperwork), spinning around  your brain is useless.

1. Exact PD of both i130s

2. Exact approval date of both i130s

3. Exact DOB of your cousin

PD - March 1995

Not sure about the approval date but my aunt says that it was approved a month after so it would be April 1995 i think

If the bolded section is right, then the children have absolutely aged out. They would only have 1 month of CSPA protection and are 26 now, so no way they can be considered under 21.

Absolutely no way that the I-130 was approved after a month.

 

Without an approval date, there is nothing to tell you.

hi guys i just had a question regarding my son who is a derivative beneficiary of f4 visa. The nvc welcome instructing me to login to my account came a few weeks ago and to my surprise my sons name, who is 25 years of age, is mentioned with the option to pay his fees (325). I wanted to know whether this meant he would be immigrating with me? If not then why are they asking for his fees and application submission? Should i give his fees even if he has clearly aged out?
