How long to deny case after interview no-show?

Had an interview scheduled (5/21/18) to adjust status from K1 visa entry.

 

We did not go to the interview.

 

How long till the application to adjust status gets denied?

 

Still no letter or anything. If I check status online it still says that "My interview has been scheduled".....same as it has for a while now.

Denial is automatic for a no-show on the interview date, so there's really no waiting period inbetween.

Online case status is not always updated.  If your wife moved out of the home after entering, it's possible she submitted an address change with USCIS and her denial letter has already arrived to her.

 

I remember some of your older threads---sorry if things didn't work out and the interview was purposefully missed.

When did you turn in your AOS package? You should consider your application to be denied if you do not reschedule a interview.

AOS turned in 12/2017

 

So, denied IF I do  not reschedule. "Going Through" says denial is automatic for a no-show on the interview date. Which is it?

Online case status is not always updated.  If your wife moved out of the home after entering, it's possible she submitted an address change with USCIS and her denial letter has already arrived to her.

 

I remember some of your older threads---sorry if things didn't work out and the interview was purposefully missed.

USCIS always seems to say that the online case status is the "most up-to-date" status available.

 

She definitely has no denial letter.

11/7/2019      Interview- Norfolk

11/10/2019    APPROVED (notification rec'd 11/10, approval dated 11/8)

DONE FOR TWO YEARS!!! ;)

 

Filed everything ourselves with no RFE's or delays.

 

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/4/20     Mailed packet

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

10/14/21 Mailed to AZ PO Box. Let the waiting begin. Again.

Got a letter with AOS interview date -> Asked for a reschedule -> Got a letter saying that in order to reschedule they have to approve it based on why I asked for a reschedule -> Did not reply to that letter -> Did not go to scheduled  interview.

 

Thats the long story told short.

Both would lead to a denial....as both circumstances still result in you and your wife not completing an interview.

This may explain why you haven't received the denial letter as quickly as you may have originally thought you would.  By not responding to USCIS's letter asking for further clarification for the rescheduling you basically put your wife's case in limbo until the date upon which USCIS expects a response in regards to the original rescheduling request has passed.

So basically you asked for a reschedule and did not provide any sort of documentation in order to change it. Then yes it will be denied.

My reasoning for wanting a reschedule was not one of their "approved" reasons.

 

So, it will be denied. Understood.

 

My question from the beginning was...How long does it take for them to deny?

When they sent the request for additional information regarding the original rescheduling request----did the letter state any date that the additional information had to be submitted by?  If so, any denial letter will probably not be issued until at least after that date has passed (to clarify---not the date of your original interview, but rather the later date USCIS wanted the clarification for your reschedule request received back by them).

 

After that date has passed, will not be long for them to formally deny it and send a letter out.

Online case status says that the application was denied and a letter will be sent out. Don't have the letter yet.

Usually 7-10 business days from after it's actually mailed.  If you got the update just today, should be mailed out by tomorrow or Monday at the latest.
