sounds good enough?

Bad idea. You're changing an official letter to something else. And how are you going to prove the name change?

I have my wife birth certificate plus a copy if his passport .. both stating his name

i asked my attorney and she said that its fine putting his new name because all they care about is his name back in US

I dont think he has that paper with him anymore .. ill try my best bringing it .. but if i couldnt bring it .. i would have to explain that to the CO during the interview

I'm sure he can get a copy of the  judge's order for the name change. I wouldn't treat this so lightly.

Do you guys think i should let the translator translate whatever name is written in the original document then explain during the interview why his name is different in usa?

The translator is required to accurately translate the document.  They are swearing that they have translated the document correctly. You will have to be the one to explain the difference with the proper documentation.  While I don't think it will be a big deal in the end, you really do need to prepare for it.  If you prepare, and you show they are the same person, and explain when the change took place, then they cannot delay your case by issuing an RFE.  Most of us try to "front-load" and answer any questions before the officers (not all of which are that gifted, shall we say?) can raise them.  Good luck.

In your first post you made it sound like you had not had this document translated already, now you're saying you already had it translated and sent in with your application. Which one is it?

I don't think he is going to believe that the translator wrote down a completely different name "by mistake".

She changed the translation completely of an original official document. USCIS says all documents you send in has to be unaltered.

I did not do anything wrong intentionally .. the translator told me that this is ok as long as i show the US passport with the new name on it .. i beleived her and did not lnow that this is wrong

so now if i re-translate the papers and show then to the CO during the interview and explain what happened to him/her i should be fine?

i mean, i dont want to pay for what a stupid translator made :(

I am actually in fear of being denied a visa because the CO thinks im lying which is making me feel awful right now :/
