My husband is not the biological father of my son but on my child birthcertificate he is the father 'coz were married before i give birth

Hello everyone. I hope somebody who has the same situation like me or is familiar about my situation can give me insights.
My problem is my husband is not the biological father and he listed on my sons birthcertificate as a father 'coz u know Philippines law , were married before i give birth to my son ..  and now we can't start to file the petition 'coz we don't know what to do .. 'coz i know the consul will ask crba but we can't do that ... is there anyone same situations like mine .. im hoping someone can help me .. thank you God bless...

July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

If you are trying to establish us citizenship for your child it wont happen. They will ask for  DNA test and they will see he is not the father. You would have to petition for your child as if he is not the father. Im the father of my daughter and when passing on citizenship i was required to get DNA test because the agent said she looked to asian to be mine. (that was a fun day) Im still currently going through the process of establishing citizenship for her.

He would want to proceed forward with petitioning both of you.

 

Don't be surprised if the embassy still asks for DNA testing during the visa application process at USEM

You can move forward with your husband filing I-130's for both you and your child. Lie already said, don't be surprised if a DNA is requested. You will just explain what happened.

 

Don't take it personal but I think the reason the question of, if charges were filed, is because if a person on the outside (a CO for example) is looking at your case, a police report or charges filed could back up your explanation of being raped. Otherwise, a person may think that you were cheating and your marriage may not be as legit as you claim.
