Thank you everyone for the advise for the issue at hand, couple questions to be answered (clarified). 

Bags were opened due to her bringing her computer back and not taking it out (she was young and was travelling alone)

Yes, this was a private school.

Yes, research should have been done on parents end.

We have moved on from this occasion (don't cry over spilled milk scenario)

This visit (current visa application) is legitimately to visit an ailing family member for a weekend. 

We were just asking for advise, not questions to re-live a harrowing experience.

Again, thanks all that gave true advise.

Which makes one wonder what the referred to “truthful” answer on the DS160 is. 

 

Yet again, half the story is told, if everything had been upfront it would have been easier to reach the right conclusion....

There is a petition in for her. Which has to obviously be stated in the DS160. No one is trying to break the law here.

I personally wouldn't hold something like this against a visa applicant. It was their parent's' decision and a lot of time has passed. 

 

Not necessarily a deal killer if someone has a lot of LPR/AmCit family. Maybe they've all followed the law and immigration process correctly. If the applicant is now a successful adult with opportunities to immigrate lawfully I would probably give them a visa.
