Really? My ead got rejected for outdated form too and what our lawyer did was have me re do the application and  resend the package along with the paper they said to put on top of the package. We got the NOA1 for the i485 few days after the ead rejection notice!

Did you already received noa for ead?

Hmm, does the paper say anything about your AOS application? I mean, I'm sure they have it in their records that you recently applied for AOS, but it depends on the officer handling your file. I think you'll be fine, though. I mean, if they reject it again because you didn't pay then just tell them you are an AOS applicant and send them your NOA1. Maybe try calling them to ask if it was really necessary to ease your mind a bit. Can't really say what is gonna happen as you never know with these guys. It's all about luck, I guess.

I hope they don't reject it again! I'll do some checks just for peace of mind!  But for me the most important is the AOS lol yes it would be nice to get the ead so i can start working but im really more interested in the approval for aos😂

This is on the EAD instructions pdf:

Adjustment Applicant--(c)(9). File Form I-765 with a copy of the receipt notice or other evidence that your
Form I-485, Application for Permanent Residence or Adjust Status, is pending. You may file Form I-765 together with your Form I-485.

Are there any documents in your EAD packet that you think may serve as proof that you applied for AOS?

But again, they should see in their system that you recently filed for your AOS so it shouldn't trigger an RFE or rejection. Let's hope the officer handling your file is neither strict nor too lazy to check their records. The good thing is your AOS application is in process and like you said, that's the most important thing right now. :) Good luck and keep us posted!

It's okay. Myself and a few others I knew from August and September forums have received RFIE 5 months after filing AOS. You being a January filer and receiving a RFIE so early is a sign that your file is indeed moving in the right processing time.

Thank you folk, I may receive the RFE this weekend. Will post to the group to share experiences.

The EAD was originally filed concurrently with the i485 and i130 I got the i797 ead rejection first then few days later i got the NOA1 for the others accepted. They sent a colored paper back in the rejected package that instructed us to put that paper on top when sending back the package to them so i assumed that was their way of identifying the application lol i may be wrong tho. Like u said I hope they don't send for any further docs.

Yeah, it all depends on the officer and your luck! Hopefully they won't be too nitpicky about it. They really should just check their system for your file, see that you applied for AOS, check your EAD docs and then send you the NOA1 for your EAD already! :)

Alright folks, I'm in a pickle. Our biometrics is scheduled for Friday (yay!) but my mom, the cosponsor, has decided to go off her rocker and withdraw her sponsorship. However, she hasn't said she's written in to officially withdraw, and she doesn't have any of his A numbers, receipt numbers, or even date of birth. So I don't even know if she can/knows how to officially withdraw. My question is: how/when will we know if she officially withdraws and when we need to have a new sponsor?!

I highly suggest you start a separate thread for this question because this is very tricky. I don't think January filers will be of much help.

Ok so I don't know much abt withdrawals but i assume based on what i read uscis would notify you if or when she withdraws!

You would think that they could do better.  We received an I-797 rejection on the AP filing for failure to pay the fee.

It was submitted concurrently with the AOSEAD, and the proper $1,225.  These forms were accepted, and the fee cashed.

Now, I will have to resubmit the AP package with the NOA1 for the I-485.

Not a real problem, but I hate the hassle.

Finally done.

Check your forms! It's probably outdated triggering the rejection and not necessarily the fee. I think that's just a general notice they send out with possible reasons for rejection! They can definitely do better.

Hello guys, anybody here living in Maryland please?

Here is my Timeline:

Priority date: Jan8th

3 NOAs received on Jan 22th dated Jan 18th

I am starting to get a bit worried because it is almost 30days and no biometrics letter appointment yet, the NOAs stated that my applications were transferred to the National Benefit center, from my little research, according to where I live it was sent to Baltimore which is pretty slow from what I read.

So either everything is fine and they are just slow or the letter was sent and maybe lost in the mail...

I signed up for Informed delivery, email notifications on the case status online and also have the USCIS app and t doesnt show any update.

My husband thinks I am worried for nothing, but I thought I would ask just to get a 2nd opinion.

Thanks

Have a great week

Hi. I live in Maryland.

My timeline is as follow:

PD: Jan 5th

NOA: Jan 11

i-797  received on Jan 18th

Biometrics notice received: Jan 27th (notice of action date written on it was Jan 18th)

Appointment scheduled for Feb 9th, I went for it on Jan 29th.

Also, the National Benefit Center is not at Baltimore, if your case number starts with MSC then your case is at the NBC in Missouri. The field office is located at Baltimore. Just give it some more few days. your biometrics appointment notice should arrive
