Hello my wife is an immigrant from Canada. She is working as a consultant for a us company using her Canadian info. We later got married and are now going through the process because our lives changed. So the decisio was sudden after she visited me for awhile.

 

My question is since she's been working as a consultant prior to our marriage and submission if this can create issues regarding her pathway to permanent resident. She hasn't received her ead yet but I don't know since she been working using Canadian info if this is ok or not as well. Thank you for trying to help us out. Have a good holiday.

Under what authorization has she been working while physically inside the US?

Senior Master Sergeant, US Air Force- Retired (after 20+ years)- Missile Systems Maintenance & Titan 2 ICBM Launch Crew Duty (200+ Alert tours)

Registered Nurse- Retired- I practiced in the areas of Labor & Delivery, Home Health, Adolescent Psych, & Adult Psych.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

 You said she is self employed but contracted to that company. Is that company strictly in Canada, no US counterpart, no US clients?

 

If so then she can continue to work. 

 

Now if they have any US clients or any bases in the US then the answer is no.

Unauthorized work IS forgiven when you apply for aos through a usc....however did she fill out a w9 with her Canadian social?? Did she ever claim to be a USC?

 

Not sure what sheet she filled out to put down her Canadian SSN...which yes, is the same about of numbers as a US SSN. 

 

If she filled out the US sheet using her Canadian SSN then she probably has problems you need to consult an experienced attorney. ..but her working unauthorized will NOT deny her the green card.

Unauthorized work is not a bar to AOS as the IR of a USC. At the same time, it is still illegal and should not be performed.
