Hi,

 

after our meeting in canada, then we might decide to get a lawyer so things will be clear..from that time, we are already more than a year since we started chatting/videocalls.  Only I am just thinking if shall we go for fiancee visa? or we will go back again in canada for a second time and have our marriage done there..

Hi,

 

Yes my passport is with me now.. but we have the options to let our HR keep it for safety..it depends on the staff. I am not worried on this.

 

I am more concern on our situation. if incase he will apply for fiancee visa after we meet in Canada, should be here in saudi? or in philippines.. I keep on searchign but i couldnt find any info that saudi is issuing fiance visa for same sex.. i am totally scared.. if there is any couple who are same sex issued a fiance visa, then my mind will be at peace...

i personally know of a same sex couple who did their fiance visa interview in abu dhabi. they were able to do it without any issues. i am sure the us embassy in saudi can also do it and it wouldn't matter to them that you are same sex. but whether you yourself will feel comfortable is another story. i hope there is a same sex couple like you based in saudi who will chime in.

yes, if there is couple from saudi who has the same issue with me, i will be really happy. there is no hassle for me to go back to Philippines just to attend interview and then i will go back here.. its very costly travelling.. we can have marriage in Canada on our second meeting rathen than waiting for the approval of fiance if we will go for it.. All i need is to reapply for a tourist visa again since my visa will be valid until nov2018 only...And i agree with some comments that its not advisable to get married in our first meeting. It might create problem/issues soon when he files for immigrant visa for me..

look at the guides here for cr1 (spouse) and k1 (fiance) so you will have an idea of what is required. note that whatever you decide, you only can chose one path (ie if you decide on a k1, you cannot get married while waiting for it to be approved). if you decide on a cr1 then you have to get married first and then apply for it.

thank you for your information indeed it is really helpful for me.. we might go for CR1 after we get married in Canada as applying for K1 will surely takes time... thank u once again for your ideas...

a cr1 takes about 12-14 months at the moment but will get you a greencard at the end of the process right away so you will be able to work right away upon arrival. a k1 is a little bit faster at 7-9 months but with it, you have to get married within 90 days of arrival in the US and then you have to apply for AOS and the work permit (EAD) afterwards (which takes from 4-12 months approx depending on which local office processes your case). without the EAD you cannot work so you have to factor that in, too.

 

there are pros and cons to both. search here on vj and you will learn a lot.

We met, married, and filed just like they intend to do.  We had no history together either.

I don't see any difference in their case than ours.  Nothing special here.  No previous flags like overstay, no waivers needed, no other special circumstances.  This was the reason for my question.

I'm not seeing it like I did back in 2009/2010.  I think they've cracked down on employers who do that.  I know that even my company "encouraged" us to keep our passports in the "passport office" back then but now if we need visa renewal etc we turn it in and pick it up.  They don't even have a passport office anymore.

You are going to run into a police certificate issue if you try to interview in the Philippines.  You have to bring one from Saudi with you to the interview. 

The letter to the Saudi government requesting the police certificate still has to come from one of the US consulates or the embassy in Riyadh. 

It's better to do the interview in Riyadh.  The US embassy does not care one way or the other about Saudi law regarding same sex relationships - they follow the same rules and laws regardless of what country the embassy is located.  My view is that they will probably treat you better knowing your personal circumstances in the context of Saudi laws about same-sex relationships.
