My K-1 fiance visa, the validity period has expired. The embassy told me, I can refile a new form with a new fee. Is this means i have to start the whole process over again? Can we get marry now, and do K-3 marriage visa instead? We have been waiting for almost 2 years and now they  told me my case is expired.

You K1 vida is valid for 90 days. If you didn’t marry during this period you have to apply to K1 again and go to the all process all over.

 

Im surprised since it seems you didn’t know that.

8/14/17 --- AOS sent I-485, I-765, I-131

8/16/17 --- AOS Packet received Chicago USCIS Day 0

8/21/17  --- Received email & text notification 

8/23/17  --- Received hard copy of NOA  

9/01/17  --- Biometrics letter notice for I-485 & I-765 & I-131  

9/11/17  --- Biometrics Appointment Done

10/17/17 - Case Is Ready To Be Scheduled For An Interview

11/30/2017 - EAD/AP Approved
12/01/2017 - Card in Production
12/05/2017 - Received Approval Notice in the Mail
12/06//2017 - Card Mailed (Priority Mail) to Me
12/07/2017 - Card Received 

1/19/18  --- Interview Date 2/21

2/21/18  ---  Approved on the Spot

  • 1 hour after the interview received uscis mobile app alert
  • Status changed from "Interview is scheduled" to "New Card Is Being Produced

2/26/18  --- Received hard copy of NOA for the Green Card

2/26/18  --- USCIS Mobile Status changed to "Card was mailed to me"

2/28/18 --- Permanent Resident/Green Card received :jest:

The k3 is no longer a thing. You can marry and do the CR1, it usually has a higher chance of success. 

 

What country is your fiance from? Some have higher incidents of AP/returned visas. I would try to think of reasons yours wasn't apprived, if it was something like not enough FaceTime together in person, just getting married won't solve that. Try to do as many visits as possible, and if you do CR1 heavily investigate problems others from the same country have to overcome them. 

 

When our K1 was redturned/expired we purposefully did 2 more visits before getting married on 3rd visit after to increase our FaceTime, chances of cr1 success. Yes it's hard to wait, yes it's expensive but you want a successful outcome.

I think s/he means that it wasn't approved at interview, not that fiance came to US and they didn't get married.

My fiance live in Thailand, I went to visited him 3 times already.  Since after  the interview last July 2016, the embassy told us to wait, they are working on our case,  but now they sent me a notice that the validity period has expired that I have to refile again.  Thank you.

They allowed the case to expire and there is no appeal for K1

so,  yes,  you can marry and apply CR1 / wait time is over a year 

i would try to find out why they did not approve (if there was an  interview)

or what else has happened

did the case take longer than a year?

now, many K1's are taking longer than a year so this affects many

sorry for your situaiton

Have you visited him since then? It may be best to get married and do CR1 now

Yes, I have called the embassy couple times, they would not give me an answer why the case was not approved and denied for a k1 visa. They told me they working on it, and told me just waited. So, now, since  the case has expired because it has been so long. I just wondered if i go back to Thailand get married and refile the marriage visa, is that going to be a problem. What would the outcome going to be.  Thank you for all your help.

Well did you ask your fiance why it wasn't approved?

Instead of a reason they just used the phrase " validity is expired". While in AP they know good and well that they can extend the validity.
Consider it dead now. 
Marry and file a CR1 and try finding out the real reason and overcome that reason in your new petition.

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

EAD/AP (renewal) approval Aug 22, 2016, NOA2 received Aug 25, 2016

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.
