I am a US citizen and got married in India to and an Indian citizen in a traditional Hindu religious ceremony. I know that makes me officially married in India. We did not however officially register the marriage in India but only have the Temple certificate the Temple gave us. My wife is currently here in US on a 6 month stay on a B1/B2 Visa. We want to file a CR1 while she is here and then she will go back to India after 6 months to wait out the rest of the time until her interview in India. My question is...should we get the the Marriage registered in USA while she is here and send that along with the application so the documentation is more clear of our marriage or should we just rely on the Temple certificate from India?

I think you might have to register your marriage in India first and get a proper marriage certificate.

I would try searching the forum if you haven't already to see if others have dealt with this.

I've seen cases with other countries where they recognized those types of certificates, but there may have been special handling when translating.

Welcome Letter: 9/15/2017

Received and Paid AOS: 9/15/2017    AOS payment cleared my bank: 9/19/2017 (still shows In Process on CEAC)

Partial Expedite Approved at Counselor Level: 9/25/2017 (Must still wait out NVC)

Scan Date: 10/2/2017    Case Complete: 11/15/2017 (6 weeks 2 days!)

Case sent to consulate: 11/20/2017     Received by consulate: 11/21/2017 (11/20 was a holiday in Mexico)

Interview Scheduled: Jan 2nd - I managed to get someones canceled appointment the very same day my case status turned to Ready.

Biometrics: Mexico City Dec 27th Medical: Mexico City Dec 28th

Case says READY but consulate says case is not in system, I jumped the gun and booked an interview but they say its invalid until I receive the letter so I might have to cancel it.

Appointment Letter: Flew to Juarez just to get this, its actually 2 letters you need.

Interview Day: Jan 2nd   Interview Result: APPROVED

Tracking Number Received: Via email notice and website the afternoon of Jan 4th    Visa Delivered: Friday Jan 5th Mexico City

USCIS Notice - Green Card mailed: 3/28/18

I personally wouldn't rely on just the temple certificate, but I don't know about it enough. Check what USCIS requires for you (country specific ) and don't risk submitting the I-130 without a proper marriage certificate that could possibly delay your case. :) Good luck!

➺ 02/13/19 Husband confesses he cheated, leaves

➺ 02/16/19 Husband decides to abandon the marriage

➺ 05/13/19  I am officially divorced. 

 ➺ 07/03/20  I file to remove conditions on my own     

 ➺ 08/13/21 I finally get my biometrics appointment 

➺ 02/26/22 I got my interview assigned: March 31st.

I believe you need to register the marriage in India and get marriage certificate from there

The marriage has to be registered in the jurisdiction it took place. You or you wife, or someone you know, has to initiate the process (usually involved bribing someone or paying a local advocate is what I hear).

I got married in India this year and registered in the local government authorities where marriage was held. To get process faster, it is good to have someone you know inside or the local party member.
