I need help with my question about AOS. Will USCIS verify my I-130 first to check my income before it gets approved then send all the details with DS-260/261 etc??? Will I get notified if I need a joint sponsor before my case can get approved to process via NVC? Much appreciated. Thanks!

nope, because the i130 has nothing to do with income. immigration will approve the i130 based on the beneficiaries relationship to the petitioner

 

the i864 is needed at the nvc stage,  after the ds261 is sent and the payment of the affidavit of support

Okay, I receive Social Security Disability with my 40 quarters earned and have 2 sons with their benefit incomes. Is it allowed to combine the incomes together for the affidavit of support to bring the only immigrant my wife the mother of the boys? It's enough for 4 to the poverty guideline income. Help appreciated. Thanks!

Thank you for the answer! After I-130 get approved, once I send my AOS form via NVC then they will let me know if I need a joint sponsor before the interview? Thank you :)

They will give you an indication whether you need one, but the ultimate decision is up to the CO.  So, even if NVC doesn't say anything, the CO may demand a co=sponsor.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

CO ( consular officer? ) at the embassy during the interview? I'm sorry if I misunderstood. Thanks! :)

you should already know if you will need a joint sponsor or not, so you can send in all together, because if you will need one, then it makes no sense to wait until you get an RFE to send the paperwork for the joint sponsor.

 

what is your current income and what will your tax next year look like? what was your tax for 2016? how many are in the household size

 

even if you don't send a joint sponsor or you don't think you need a joint sponsor, the officer at the interview has the discretion to request a joint sponsor if he or she doubts that your income isn't enough

I'm on Social Security Disability with 40 quarters earned and receive my sons' benefits as well to combine the income the size of 4 together the only immigrant would be my wife, the boys' mother.

  1. If you included the income of your spouse listed in Part 5., Item Number 3., any child listed in Part 5., Item Number 4., any dependent listed in Part 5., Item Number 5., or any siblings, parents, or adult children listed in Part 5., Item Number 7., each one of these individuals must be over 18 years of age and must complete Form I-864A.

 

I think their grammar could use some clarification on this point - it is ambiguous on whether you can use a dependent's income if they are under 18.    Let's assume that you can, do you not make 125% without using it?

 

Then there is this:

 

You may use the income of your spouse and/or any other relatives living in your residence if they are willing to be jointly responsible with you for the intending immigrant(s) you are sponsoring.

 

Can a child be responsible for an intending immigrant?

Hmmm,

Myself a SS pensioner earned 40 quarters with SSDI, my USC boys living in the Philippines under SSA act with benefits also receive SS  combine the income together to meet the household of 4 ( myself, 2 sons and wife ) The only immigrant is the mother of my boys to immigrate. I am trying to understand the instructions from I-864 if its allowed or not

I'm still trying to read and understand if its allowed together the incomes of myself and my USC boys ( ages 5 and 4 ) under SSA act with benefits to meet the poverty guideline  to support my boys' mother an immigrant. Help would be appreciated! Thanks!

Please kindly help with my stupid question I need to know about Social Security Disability I earned 40 quarters of work and easily meet the poverty guideline to sponsor the only intending immigrant is my wife. My wife and I have 2 USC ( via CRBA ) sons together receiving SSD benefits as well. Can my sons and my SSD incomes be combined for affidavit of support to bring my wife ( the boys' biological mother ) ??? I am trying to find this source anywhere to see if it is ALLOWED or NOT? Thanks!

Let me clarify again here to seek some help if possible. Here's it is.

 

Myself, a USC petitioner with I-130 for IR-1 category have a question here. My USC minor children via CRBA are living with me and my wife as a family here in the Philippines. It`s just the four of us. So, As I understand regular Social Security can not be counted toward income but Social Security Disability (SSDI) does count. My income is all from Social Security disability and as well my minor children also receive  SSDI benefit based on my disability. That monies are paid to my wife under my childrens' names. Am I able to count this as part of my household income? Any info you can pass along would be greatly appreciated.

SS Disability income AND SS retirement both count as income on an affidavit of support.  Yes can combine income with members of your own household.

What is it you want to know exactly?  "it" tells us nothing about what you want to know is allowed or not.
