Hi everyone, I'm a July 2016 filer who just got an RFE, sadly. I was hoping to get some advice on what else to send USCIS. 

 

What we submitted: 

  • copies of 2015 tax returns
  • one page of a joint bank statement from 2016 
  • copy of joint health insurance card
  • copy of joint auto insurance policy from 2016
  • copies of a trip itinerary from 2015
  • photos
  • an affidavit

 

The RFE letter states that "the evidence submitted does not establish, in sufficient detail, joint ownership of assets, joint responsibility for liabilities,  and/or an active commingling of finances for the duration of the marriage." There's a paragraph about children, which we don't have.  We could add my name to the deed of the house, but that would involve an attorney. Should we send copies of our bank statements for the entire time we've been living together? We are also going to add my name to the utility bills. Neither of us have a will, which the letter mentions (didn't think it was necessary at our age (30s) with no kids planned. Would more affidavits help or be useless?

 

I'm also confused at the date on the RFE letter. I received this in the mail yesterday (Sept 11th), but it's dated Jul 17, 2017. My NOA extension expires on 10/11. So we don't have much time to prepare all this evidence, send it back, and hopefully get approved. I do have an infopass appointment booked for Sept 25th to get a stamp. I'm just wondering why this letter took so long to get to us. (We haven't moved). 

 

Any help would be greatly appreciated.

You needed to send way more bank statements.  At least quarterly if not monthly for the entire time the account has been open in both names.  Send the entire statement too, not just the first page. 

Wills are important when there are assets involved especially with a foreign spouse whose name is not on the title/deed to the house.  Wills are pretty easy and cheap to get done depending on your state. 

Do you have any other joint items? Registration on vehicles?  Joint credit cards? Loans? Etc...

The letter means at least they've finally looked at your file which seems in tune with current processing times.

Yes send bank statements from opening to current. Do you have any life insurance policies that state beneficiary?

I am just wondering you said, you are july filer but your NOA expire 10/11 ( My NOAextension expires on 10/11), it means that you are August filer. NOA is about one year from the day of filing NOA

Please let me know if I am wrong.

Noa1 actually expires 1 year from green card expiration.

We also received a RFE as our initial evidence was about the same as yours. We went online and did a Power of Attorney  (Health) for each other, very quick and simple to do, as we haven't prepared wills yet. We added a selection of mail addressed to both of us and individually at the same address. We put in a couple of doctors bills showing we go to the same doctor and related documents from our health insurance. I made my partner a beneficiary of my retirement fund and included a print off showing that.  We put in travel documents -  etickets, boarding passes etc showing we took trips together.  We went through everything we had and included what we thought was relevant. But just as important was the cover letter explaining why we did not have some of the required evidence - my partner has owned her house for years before she met me and we didn't feel the need or want to go through the expense of putting my name on the title. Same with the utilities, they are long standing accts and we did not see the need to put my name on them. We dont have credit cards because we don't want them - if we cant afford something we don't buy it.  We just explained our situation and the reason why we don't have some evidence honestly. So I would suggest you find any evidence you can, but if you legitimately don't have it explain why in the cover letter. Good luck! Oh, we got approved 3 weeks after submitting our rfe.

Hello- I just filed in August but I would recommend send your entire bank account record- we submitted ours from when we first opened to present. We also submitted about 6 months of credit card statements in which we are both joint holders. We also sent photos of trips together, photos of us with friends, photos of us at special events, copy of our IDs which shows the same address, joint tax returns the 2 years he has been here, proof that my husband is on my health insurance and life insurance from work, a piece of mail sent to us, our itenary and bill from our honeymoon, 2 affidavit of supports and a letter from my parents stating that we are are allowed to live here/been living with them since my husband came from Haiti as well as the deed of the house that shows my parents own it. 

 

 

We dont don't have children, we don't have any bills (other than credit card) that are in both of our names and he does not yet drive so there is no car insurance with his name. I feel with everything we have it was enough though. Good luck!

Thanks for the help so far everyone. :) We have almost everything ready to go. Printed out monthly bank statements since I was added to the account, copies of both utility bills showing my name, last year's tax transcript, and more affidavits. Unfortunately we are unable to add me as a beneficiary to life insurance since it isn't open season yet. (Kicking ourselves that we neglected to do that before, but will explain on the cover letter). As kakadu mentioned, we will also explain why we don't have some of the suggested forms of evidence. Already sent copies of both our credit cards and licences. No other joint items that we can think of. So, hopefully this will be enough!
