I239 Petition expired?, NOA 2, valid to and from dates

I am concerned and I know that I read about once the original petition is filed by the petitioner (which is me) that one only has so many months before the petition expires.  This is a concern because you want to make sure that everything is processed within this time period.  In my case, my NOA 2 approval Notice says it is Valid from 5/5/17 to 9/4/17.  If I am correct in my thinking, this puts us outside of normal processing time.

 

With that said, my fiance' had his interview at the Cairo Embassy on August 15. Everything went well, but now we are in the AP review stage even as of today 9/7/17.  I know this process can take up to 60 days.

 

What my concern is, do I need to file something since the valid period about has passed?  Thank you in advance for your responses/answers.

AP can last a few days, a few weeks, or months. There is no normal time frame for AP.  There is nothing you can do unless the embassy asked for something during the interview. Your only option is to wait........Good Luck.

He needed to have the interview booked before the NOA2 expired.  The embassy will automatically extend the validity if an interview is booked.  After that it doesn't matter when it expires.

The embassy typically renews the approved petition for up to 1 year. Since you're in AP, they should be renewing it as necessary until they make a decision. You don't need to worry about it expiring while they are still working on your case.

Thank you for that info.  My fiance had the first interview on 8/15.  Should I make appt. for a second interview?????

If they need a second interview, they will request it. You cannot schedule an interview to address why the case is in AP.

Edit: But the petitioner can reach out their local senators to request an inquiry on the status. They can't make them make a decision, but it won't hurt either.
