If there is a RFE, in i130 filling how long they notify?

I'm thinking that I'm abou to get a RFE thinking we missed a paper in i130 step, the very first one, and my question is, based in your experiences, in case of getting it, in how long (days, weeks) they notify about that? 

I have the missing paper just ready, but I'm waiting if RFE or NOA 1, NOA 1 is about 2-3 weeks (average) would be more or less, that's clear for me, but in case of RFE, it would be more time than that, or the same,less maybe ?

That 's my today question.

 

P.S for those spouses currently living in Texas U.S ,CORPUS CHRISTI , PORT OCONNOR , please, be carefull with Hurricane Harvey.

What do you think you forgot? You only sent it Monday, so they probably haven't even accepted it yet for processing.

 

If it is a big enough issue they simply won't accept it and will send it back. If they accept it but eventually issue an rfe that won't happen for around 5-6 months, and it will likely delay the issuance of the noa2 by about 30 days (can be up to about 60 days).

I'm going to receive a NOA1 (in the mean time 2-3 weeks) but, when they start to check all my papers if there is something wrong between NOA1 and NOA2 if something is wrong they've send the RFE? Is correct, or I'm wrong again!

If they accept it and issue the noa1 then it will go into a pile. No one will look at it for about 5-6 months. Then once it gets to the top of the pile someone will loook at it and either approve it (issue noa2) or they will send an rfe requesting the missing information. Once you submit the reply to the rfe it will take about 30 days for them to review it and either approve it (noa2) or again ask for more evidence.

 

However, as I said before, if it is a big enough issue they may just not accept the petition to begin with and just return it. What do you think you forgot? Have they cashed the paynebt check?

Spanish Photocopy of Marriage, we sent the translate! All the other things are in the file, only tha one thing missed! All the other things are in there, photos, Affidavits, i-130 and i-130a ,Certificate of Naturalization, everything, just that missed!

 

So what I still asking is...

This is my scenario:

 

As you well say, is not like we missed two or three required papers, (only one) , they've accept it and i receive  NOA1, but if they consider to ask me that copy before NOA 2 they are going to send me a RFE!? I'm I correct?

Well, only what I mentioned it, the Spanish Photocopy of our Marriage Certficate, we send the Translation (that includes all the data)!

In your opinion would this be a reason for reject all the package?

It is not about how many documents are missing. It is only things like missing paynebt, missing I-130, etc. that would cause them to not accept the petition.

 

They will likely accept it and issue you an noa1 within the next month. Then all you can do is wait. They will likely issue an noa2 in about 5-6 months when they get to the case (unless you are unlucky and your case gets assigned to Nebraska).

 

Once they get to your case and notice the issue then they will send you an rfe. This won't happen for about 5-6 months from now (or longer). At this point there really isn't anything you can do but wait. You can't submit it till they send the rfe. Besides they may ask for more stuff than what you expect.

 

Always carefully review the packets. Store sending to make sure they are complete and make copies of what you send to keep for your records.

Well,when you say paynebt , you mean the money order (that's waht my wife did) exactly like she did for her citizenship and my father in law.

A money order for $535 USD (INCLUDED IN THE PACKAGE).

Well so, probabily I receive my NOA 1 but in NOA 2 stage there is when we are going to receive the RFE (if needed).

Well this clarifyes me a little bit!!!

Well she buy a money order in a postmail office for the $535 amount required for i130!

And placed onto the package the money order!

This was the same procedure that she made for her citizenship and also for my father-in-law's citizenship...

 

This means that was done correct right? 

And if so, we are going to get NOA1 !?

No problem, they may accept the one that you sent. There is no way to know till you either get the noa2 or an rfe. Either way you just have to be patient and wait. It is also possible that they will lose a different document that you did submit and they may issue an rfe for that. They are notorious for losing documents.

Ufff , thank you, really, at least, getting NOA1 our case will be in the system and is just a matter of patience and wait...

Just wanted to chime in, our RFE got processed within 10 days after being received, so just in case there is any hiccups -- USCIS seems to turn things around fast. At least that is what happened to us, but I am sending some good juju your way and hope that you will fly through the whole thing without any RFEs etc.!
