Timeline

I arrived in the USA in late July on K1 visa and got married to my American spouse in early August. I am filing for I-485 (Application to Register Permanent Residence or Adjust Status) and I have a few questions about filling it. Thankful for all the answers and help! :)

 

Part 1. Question 12. US Social Security Number. I will apply for it this week but it takes 2 weeks for me to get it. Is it necessary to have before filing for I-485.

 

Part 1. Question 16.  “Travel Document Number Used at Last Arrival” - What is this? Is this my passport number or the red K1 visa number?

 

Part 1. Question 22. Is 22a correct answer: When I last arrived in the United States, I: Was inspected at a port of entry and admitted as (for example, exchange visitor; visitor, waived through; temporary worker; student): 

 

Part 1. Question 24. How to answer:What is your current immigration status (if it has changed since your arrival)?” 

 

Part 1. Question 2. “Are you applying for adjustment based on the Immigration and Nationality Act (INA) section 245(i)?” - Do we answer yes or no?

 

Part 1. Question 3 and 4. If you are the principal applicant, provide the following information.” - Am I now the principal applicant? What is meant by: “3. Receipt Number of Underlying Petition (if any)” and “4. Priority Date from Underlying Petition (if any) (mm/dd/yyyy)”

I believe you can apply without it. That being said, I applied for it and got it within a week. Might be worth just getting it to avoid any RFEs.

This would be the number on your K1 visa.

Absolutely yes.

 

Part 1. Question 24. How to answer:What is your current immigration status (if it has changed since your arrival)?” 

 

I put K1 on my application.

 

Part 1. Question 2. “Are you applying for adjustment based on the Immigration and Nationality Act (INA) section 245(i)?” - Do we answer yes or no?

 

The i-485 forms have updated, so hopefully a newer filer will help you out on this one. 

 

Part 1. Question 3 and 4. If you are the principal applicant, provide the following information.” - Am I now the principal applicant? What is meant by: “3. Receipt Number of Underlying Petition (if any)” and “4. Priority Date from Underlying Petition (if any) (mm/dd/yyyy)”

You are now applying for yourself. You are no longer the beneficiary. Always the applicant. That section is for those who have come over with children or more than themselves.

4. I'm sorry. I'm not sure about this. It could either mean if you have any existing applications or from your precious K1 process. This website has answers in every corner so, try searching your questions individually. You'll most likely get more detailed answers. Very often there are sample forms that you can look at on this site where it will give you an idea of what should go in each field.

6/12/2017: Biometrics appointment completed

7/27/2017: Case ready to be scheduled for interview

8/24/2017: Interview Scheduled

9/5/2017: EAD Received

9/27/2017: GC Interview

9/27/2017: GC Approved

10/5/2017: GC Received

8/02/2019: i-751 filed (sent UPS to Lewisville, TX)

8/07/2019: Check cashed

8/12/2019: 18 month extension received 😎

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

It's a "no" on the INA question.

 

The receipt number they're asking for is the WAC receipt number the petitioner got when s/he filed for the i-129f petition. I don't remember if K-1s have a priority date or not. Check the NOA1 and/or NOA2 from the i-129f petition to see if there's a priority date on them. 

Current immigration status should read "K-1 visa holder". Only "K-1" is probably fine too.

No not needed at all. Some people who file for AOS can't even get a SSN until they receive their EAD, so for those people it's not even possible to have a SSN when filing for AOS. You who arrived on a K-1 could've applied for a SSN the same week you arrived in the US though, is there a reason why you didn't? It doesn't matter for the AOS though, it's not a requirement.

Undoubtedly no!

I have received my SSN about 1 month after I filed for AOS with EAD and AP.

I have received my EAD and AP without any issues or RFEs.

 

SSN is not required for AOS!
