Haii everyone,  please your advice.

 

I and my fiance are confused to choose what visa we should take. We were preparing our fiance visa but suddenly we want to do spouse visa. My question is after i get married with him and we apply for spouse visa, ( so the spouse visa is processing) can i visit him with the tourist visa?

Your ability to visit him with a visitor visa will depend on (1) ability to get visitor visa based on ties to your country (2) if you already have a visitor visa, keep the ties to your country in case you are asked about it when you enter the US.

 

Many people visit their fiance or spouse in the US. However, some are unable to get visitor visas and cannot visit, so it will depend on that. I'm not aware about how hard it is to get one in Indonesia.

I think to get a tourist visa is not that difficult. They just want to make sure that you won't be an illegal immigrant there. You will come back to your country for some reason like for your job and your family.

And for sure, i will come back because i don't want my case doesn't work.

Well, they could actually worry about you wanting to AOS in the US rather than doing a CR1/IR1 because your husband is in the US.

 

Family is not an important factor as a tie to Indonesia since your husband will be in the US and you are planning to move there through the IR1/CR1.

 

A good job might be a good tie.

 

You might want to apply for a visitor visa a.s.a.p. before marrying or submitting any form. If being able to get a visitor visa is important for your decision between a K1 and a spousal visa, then it is better to know whether you can actually get one. Otherwise, if you go the spousal visa route you won't be able to visit 12-14 months.

You can apply for a visitor visa now.

If she's asked on her DS- 160&by a Consular Officer at the Visa interview if she has anyone in the US of which she truly has one(her fiance) then tells the truth,she will definitely be denied the Visa. Again,if she denies she doesn't have anyone in the US&she's issued the tourist visa then applies for the K1/CR1 visa later,she will also be denied for lying to the U.S. government which will cause her more problems&then files a waiver that may/May not be granted. I think the best route for her will be the Spousal(CR1) Visa while the quickest route for her will be the Fiancee(K1)Visa

Yes, that is a good idea. If you are rejected, good reason to go for a K-1. If you get the visa, then you know you'll be able to visit while waiting for your spouse visa.
