Congratulations on getting your EAD! Is AP approval a different date than EAD approval? I thought they are in the same card.

Wow. congrats! I just joined VJ after hanging outside and being frustrated by myself for 4 months. I filed AOS from F1 on July 10,  my EAD has been pending 127 days since i received the NOA on 7/12. i guess my office is super slow.

Hello i saw i have very similar timeline as you did. I have some questions i hope you can help me. 

When i filed i remember my lawyer asked my employer to provide a cover letter for expedited request, so i thought mine should be on this process already, but it never shows on my USCIS case history, does that mean i didn't get expedited request? Should i call USCIS to request? 

 

I saw you have 2 separate dates for bio of I485 and I765, but i did mine just on one date. I did see my bio I797 notice says "I765-I485", so does that mean i did them both at the same time? I am worried if i missed one bio.

Hey! In terms of your first question, you should call USCIS and verify this. Ask to talk to a Tier 2 officer because they give you a better answer than the regular agents that we talk at first. It seems like the expedite request didnt go through :( You sent the employer letter or was it your lawyer? 

 

And the second it's because there was a confusion with USCIS regarding my packet :( I filed everything in july on the same date and when I got my NOA's I got a rejection for the I-765 saying I didnt file the proper fee for it which it isnt the case for us so I had to send the form again and that's why I have two different dates but if it wasnt for that i'm sure Id have done a bio appt for both I-485 and I-765 on the same day like you :)

Thank you for your explanation. Yes, my company's lawyer helped my send the packet so i assumed they sent the expedited request. 

 

On a side note, i filed to National Benefits Center, yesterday when I was on USCIS website, i saw that center already started processing I765 filed in September while mine was in July. I am really panic right now. :( I feel the lawyers are not in a rush at all, maybe they are too used to this. I kept asking what I can do, they just say i will have to wait.

Yeah you should really talk to a Tier 2 officer. It seems like your lawyer is not being too helpful at all :( You need some explanations regarding your case and you can get lots of info with a Tier 2. You should just call USCIS and ask to talk to a Tier 2 officer and they'll transfer it for you =) 

 

Also, have you thought about asking your congressman? I asked mine because it was taking too long to get any news on my EAD and I think it was very helpful =)

Oh gosh, i just called USCIS, i asked to speak to tier 2 officer, that agent just asked me why and said tier 2 officer will give me the same answer. And when i asked if there is any expedited request on my case, she said no. So i asked to raise one, she gave me those categories which i was not sure which one mines fall under. I just told her i have job offer and i stopped working in the middle for 4 months so i had no income, i don't know which category it can fall under. Then she was all grumpy and saying she cannot help either i should check USCIS website. Then i said maybe it can be the first category, company or personal finance loss. Then i asked again if i can speak to tier 2, she said there is no differences. So finally she agreed to raise the expedited request but still didn't tell me if that's legit. Anyway she just kept saying the avg processing time on the website is not good reference, if they tell me they are reviewing my case then they are just reviewing.  Still i feel my case is pending wayyyy too long. 128 days so far. You are right, my lawyer is not helpful. i will wait for another 5 days as she said they should give me a response on the expedited request within 5 days. If not, i will contact my congressman. :(

That is so strange; first of all the Tier 2 officer has a lot more answers to your case than the standard, script-read, answers of the first agents. Second, they can't deny the transfer for you. You should call again and ask to talk again to a T2, because that first agent was being really difficult.

 

128 days is a lot to wait for a simple answer. Your lawyer should have been able to help you out with this :( 

 

Try this: Call them again, ask to talk to a Tier 2. Regardless of what the agent say, insist on talking to a T2. Then explain the situation to the officer once you're transferred and discuss with her/him your case and your options. And I think you should contact your congressman soon after. I hope you can get some answers really soon, this whole waiting process is a nightmare =(
