Applying for IR-1 in Third Country

Hello, I have been looking around online for a while and can't seem to find much information specific to my situation.

 

I married my wife in Vietnam just over 3 years ago. We live in Vietnam, and I have been living here for 8 years. She has traveled to the US with me on a tourist visa after we were married.

 

I have never applied for an IR-1/CR-1 visa because I didn't plan on moving back to the US anytime soon.

 

We ready to leave Vietnam and are in the process of relocating to Europe to pursue master's degrees.

 

My question is this. After we have been granted our Austrian residence permits, will I be able to carry out the visa application process at the US embassy in Austria?

We will live here for 2-3 years, and then return to the US to settle. Hopefully she will have an immigrant visa at that point.

 

Am I able to apply as a sponsor while living abroad? I knew several couples that did it while in Vietnam, but the 3rd country is making things complicated.

 

Does anyone have any experience with this sort of application? Any advice, insight or reference material you can direct me toward?

As a main sponsor you need an established domicile in the US or your visa application will be denied. No matter where you file it. 

K1

29.11.2013 - NoA1

06.02.2014 - NoA2

01.04.2014 - Interview. 

AoS

03.2015 - AoS started.

09.2015 - Green Card received.  

RoC

24.07.2017 - NoA1.

01.08.2018 - RoC approved.

You just need proof that you intend to reestablish domicile either before the applicant arrives or arriving at the same time of the applicant.

10/2014- Visited Nigeria and he proposed!!!! 
02/28/2015- Sent I-129F petition
03/05/2015- NOA1
09/2015- Visited Nigeria again!!!
10/28/2015- NOA2 (237 day wait at TSC)
11/13/2015- Sent to NVC
11/27/2015- Arrived at Embassy
06/2016- Third visit to Nigeria!
06/15/2016- Interview, given option to file I-601 waiver.
08/16/2016- Waiver submitted (no lawyer).
11/21/2016- Waiver approved with expedite.
01/2017- Embassy requested interview. 
04/2017- Fourth visit to Nigeria.  K1 officially denied. 
04/25/2017- NOA1 for 2nd K1.
07/27/2017- Case transferred to TSC.
11/17/2017- Case transferred back to CSC.
01/16/2018- NOA2!! (266 day wait)
03/08/2018- Interview (AP)
05/03/2018- VISA APPROVAL!!!
05/14/2018- Visa issued
05/18/2018- Visa picked up
05/25/2018- HE'S HOME!!! 💙💙💙

We will be staying in Austria for our studies, and then plan to relocate to the USA.

 

I have maintained a residence in the US. What would be the smoothest way to the US after our studies, without having to stay in limbo in Vietnam?

 

What is the average IR-1 approval time frame these days? My friends in Vietnam ranged from 20-26 months from application to approval.

September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

January 28, 2014: Production of new Green Card ordered

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

July 23, 2025:  Filed N-400 online
