so my husband is a u.s permanent resident, and a dominican republic national. getting ready to petition to bring my stepson here my husband does a dna, and has been excluded as his father.he is our son, no matter what, and we want him here with us, i just dont know what to do now. our lawyer we have there in the DR is out of town and unreachable and our lawyer here in the states isn't available until next week, and im so impatient and i need answers now. does anyone know the law in the dominican republic concerning adoption? the mother has absolute no idea who the father is and is on board with us still keeping him. so how does my husband legally adopt his so he can bring him here?

This will be a problem for immigration purposes.

 

I mean this with all sincerity but you and your husband should prepare to accept that you son will not be able to immigrate to the US.

 

I know you have accepted him as your child but there are too many legal obstacles you would have to overcome. With living parents it will be extremely difficult to adopt for immigration purposes. @NigeriaorBust provided good sources of information about the process.

 

Then you have the moral side of it. What if the biological father wants to establish a relationship with his son? You can't deny him that right. Just like your husband, up to now, he did not know the child was his. He has a right to move forward with being a father. 

 

Very tough situation to be in and my sympathies to you. When your lawyer is available it is best to consult with him/her.

Have you been married for 5 years?  If not, the DR will not approve you as adopting parents.

 

How old is he?  You have to be able to finish all of the adoption procedures, the immigrant visa process, and have him enter the US prior to him turning 16.

 

You would have to adopt jointly with your husband, as an LPR cannot file a petition for adopting a child. (I mention this since your question was about how your husband could adopt him...).

 

One of the most difficult issues is that, under the Hague requirements, the DR would have to try to place him for adoption with an in-country family prior to him being eligible for an inter-country adoption.  Not sure how that wo u ld make you, his mother, of the child feel....and what happens if they do find a place ement for hime in the DR (unlikely, but still a risk)?
