Hi everybody,

I got in a very unpleasant situation. My temporary green card got damaged and i don"t have it anymore.

I have to apply for my PERMANENT green card in 30 days and I don"t know how, because in order to send a package with i-751, I have to attach the copies of my temporary card.

Does anyone know what to do in this situation?

I have no time to renew my previous green card :(

Timeline

 You need to file a police report and then file for a replacement green card ( and pay the fees)  and include copies of both with your application. 

This will not be over quickly. You will not enjoy this.

This is an awkward position to be in.   If you do apply for a replacement card it takes around 5 months, and you wont physically get your card before it expires, it also is expensive.  Now I do know that someone on this site had the same situation and needed to travel and went to an emergency appointment to get an i55i stamp and they got it for free and did not have to apply for a replacement card. However, I do know someone who had their wallet stolen went for an i55i stamp and was refused as they didn't have an i90 in the process.  That person would be me.  My husband has sent a letter of complaint as it seems its one rule for one and one rule for another. I know you can't apply for both of them concurrently or so it says so on the USCIS website, however I was told to do so but was also told that the i 90 would cancel itself out due to the ROC application.  I know it doesn't help much, but if and when we receive a reply to my husband's complaint I will let you and the community know the correct procedure to follow, whether it is to ask for an i55i stamp or pay a few hundred dollars to apply for a replacement you just won't receive.

I've said it before, and I'll say it again:

 

Per USCIS, YOU CANNOT FILE AN I-90 if you're within your 90-day filing window. In the instructions they say (and I quote):

 

"NOTE: Conditional permanent residents (for example, CR1, CR2, CF1, CF2) who obtained their status through marriage or entrepreneurship are issued a Permanent Resident Card for two years. When a conditional permanent resident’s status is within 90 days of expiration, the conditional permanent resident is ineligible for a replacement conditional resident card and must file a petition to remove the conditions"

 

@shell20's story should not have happened according to their own rules.

 

So, when you say 30 days, are you still outside the window and it opens in 30 days, or does your conditional GC expire in 30 days?

I only wish the USCIS field office knew this, as when I asked for an i55i stamp they point blanked refused, they even asked a supervisor who said no, then they told me to apply for an i90 even though I had filed for ROC and I said that is ridiculous. I had just paid hundreds of dollars to get a transportation letter back to the USA. (My wallet/purse was stolen whilst visiting family in England).  I said if I apply for the i-90 I wont get a card and I will pay a few more hundred dollars for it to cancel itself out. They said yep ,but unfortunately if you want the i55i stamp you have to apply for a replacement for your stolen card. Which added insult to injury.  I broke down in tears at the office. Now Im stuck in the USA  unable to visit my family for a year or so, unless I want to throw money away just for a stamp. It would be the most expensive stamp I have ever paid for and I am NOT a stamp collector!  Not to mention all the other stresses we are going through, just awful stuff happening in our lives right now.

You should probably make an "Infopass" appointment at your closest USCIS office and ask them what you should do... and (not judging, since ####### happens to all of us) when you get your new card, eventually, make sure you scan it/photograph it (both sides) just in case. 

Good luck - clearly you're not the only person this has ever happened to, so I'm sure there's some kind of protocol in place at USCIS to deal with filing your ROC under these circumstances.

I called USCIS. I was told to fill out i-90 to replace my temporary green card. Then I can apply for my permanent card, even though it takes up to 9 month to renew the old card.

I suggest an infopass at a different office.

I know from first hand experience how inconsistent they can be, and the seeming ability to recite 'rules' that have no basis in fact.

 

 

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

I AM JACK'S COMPLETE LACK OF SURPRISE

 I-751 Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

That's why you need to make an info pass. I've read that they won't replace an expired card, and in the meantime you're in trouble for not filing I-751. When you call uscis you get a glorified operator, who probably doesn't have the right facts. If you speak in person with an actual agent they might be more able to help.

You're way too gracious towards USCIS after what you have been through!  I will see what is said, if we even get a reply and if we don't it wont be my husband who writes the next letter. He, bless him, seems to only understand part of this as he does not frequent visa journey. However, i am not as patient and watching my husband going through so much personally tright now then I will be the one to take the "Bull by the horns". I am sick and tired of us paying out money we simply do not have, just to line the pockets of greedy money making enterprise.  

 

This is not about immigration issues, this is simply a money making business and customer service or the service you get for your money is absolutely appalling. I wouldn't pay for "fine dining and then say its ok for a hot dog, just because they were busy, so why should we pay for a service that we simply aren't receiving?

 

 Funnily enough I went to my bio-metric appointment and I was talking to someone there and I casually said, well this is going to be a LONG wait, they said no, it wont be, you will get an interview.  I said no I won't its around 13 months at least. They again said no you wont wait that long, you will get an interview here. I said no I wont, they rarely do interviews, so I will have to wait at least a year.  I cannot help wondering if they knew something I didn't as this person, was there a year ago when I lost my GC at Philly airport. Well I gave it to my husband with my passport and then it was gone, so its happened twice to me and thousands of dollars later, I don't have one!! :(

Absolutely no protocol for this, it's whatever they think of saying to you at the time, one rule for one, one for another, no consistency. I truly believe they make it up as they go along!

This is one persons experience in much the same predicament as mine and the OP, but they had such a different outcome than I.

If your window opens in 30 days, then you do have to file an I-90 and submit the receipt notice when you file your ROC.

You will likely ever see the new temp GC.
