I am so sorry your husband's visa was denied. I know how heartbreaking that decision can be. If you can provide us with some more information, we might be able to help you figure out what happened. 

 

- What questions was your husband asked? 

- How many times have you traveled to Ghana? 

- Did you frontload or sideload? Meaning did you send quality evidence during the first two phases? 

- Do you have red flags such as an age gap, too short visits, married on the first visit, etc? These are all things many people on this site have been denied for. 

 

If you don't want to give information, you should at least contact your local Senator or Congressman to contact the embassy on your behalf. That will be the only way to possibly find out the reason you were denied and figure out the best way to move forward. 

 

Unfortunately you have a long wait ahead, probably 12-18 months before you hear if the USCIS will reaffirm or revoke your case. This feed could be useful for you. It's with others who have been denied and are working on getting their cases reaffirmed.

Hello everyone!! I am new to this site. They asked him several questions. He was interviewed in Ghana.  We included documents in all three stages. He was denied and gives 221g and told case was being sent to Washington but paper states cases was going to USCIS.  Just trying to understand.

Ghana is one of the toughest embassy's to go through and many petitions are returned.
This is the process:
1. Embassy returns petition to USCIS (in 4 -6 months, they like to sit on it for a while).

2. When USCIS receives the petition they will send the petitioner a NOIR/NOIR letter that has to be answered within 30 days.

The petitioner is given the chance for a rebuttal of the CO's findings by answering the letter and include evidence.
The letter will name the reason(s) / issues to be addressed.
3. If satisfied with the petitioner's rebuttal, USCIS will reaffirm the petition and send it back to the embassy with recommendation to approve.The embassy does not have to approve it but can return it again ( it is mostly reaffirmed ).
Sometimes USCIS will not send a NOID/NOIR letter and bypass the rebuttal and send it to the embassy though that has
been rare in recent years with Ghana returns. If USCIS is not satisfied with the rebuttal then they will deny the petition.
4. Embassy receives the reaffirmed petition and the beneficiary is in queue to have a second interview, they either approve
or return it again or let you marinade in AP for a while.

NOID = Notice of intent to deny.
NOIR = Notice of intent to revoke.

The process from the interview and return to second interview can take 18 months to 2 years + and you should collect good

ongoing relationship evidence with as as many visits to Ghana as you can. Joining others members here in the Ghana thread
helps to know you are not alone going through this and gives hope to those following the ones who made it through

successfully. Though each case is different there will usually be a pattern to observe as far as time processing for each step.

You should also make occasional inquiries through your senator as to the status of your petition because Ghana and USCIS
will not tell you what's going on (or give you misinformation) and not knowing where your case is can drive you crazy.
Form friendships with those who are going through it if possible, even if it is just with phone calls or online chats, it helps
to get through it.

Yes, that is the usual, sometimes sooner and sometimes later. My guess is they wait until they have a batch to return all
together and sometimes perhaps to discourage the couple hoping they will give up if they feel the relationship is not
legit.
After a month or so you can have your senator request that the embassy return the petition instead of holding it there.
You are in charge of what you want your senator to do, they can't read your mind nor do they know exactly what to ask for
if you are not specific with what you want them to do except for a general inquiry, so be specific.
For example ask for the diplomatic pouch number the petition was returned in and keep it for your records. While it
is not really useful otherwise, it confirms it was truly returned. Sometimes you get "It has been returned" from the
embassy and  "It has not arrived" from USCIS and meanwhile you wonder for months on end where your file is, so the
diplomatic pouch number will help confirm it has definitely been returned.
Once USCIS has it you wait again for several months and months until you receive the NOID/NOIR letter.
Then you have only 30 days to submit your rebuttal so be ready with evidence.
Then you wait again until the embassy contacts you.
Be proactive, know the process, guide the senator's aid assertively and confidently, do not rely on them to
do do it all by themselves and remember they can't speed up the process nor can they override the decision.
Have a reasonable back and forth relationship with them but do not bother them too often either.
If one senator is useless, use the other one. There are offices in different cities you can contact.
Settle in for the long haul. Nurture your relationship and talk daily to your fiance.

Second Biometrics appointment letters received for EAD and AOS on Aug 15, 2016 for Aug 17 ( 2 day notice).

Second Biometrics completed Aug 17, 2016

Third Biometrics appointment letter received Aug 19, 2016 for Sept. 1, 2016. WTH ?!

EAD/AP (renewal) approval Aug 22, 2016, NOA2 received Aug 25, 2016

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.
