Hi everyone, my wife came to the U.S with a K1 visa and we filed a former I-485 and the case got denial after fail to prove cosigner asset.

Can we reapply for another I-485 and can my wife stay here while the case is being file again?

Yes, she can stay now while you guys re-file a.s.a.p before the expiry of her I-94 (which is deportable). If you want to use the same co-sponsor, then you'd need to gather supporting documents to prove the assets that weren't proven before. Otherwise, look for a new co-sponsor. All forms and documents will have to be resubmitted along with the payment which is currently $1140 + $85 since 23 December 2016.

ROC filed on December 1, 2020, assigned to SRC, approved within 106 days on February 18, 2021.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Did the denial formally state it was due to co-sponsor assets? I've read of of RFE's being given due to issues with sponsorship/co-sponsors but I didn't know it was a straight up denial. I'm really sorry about that. As stated by KULtoATL you will have to re-file and pay again, super bummer, but the nice part is you've already done all the hard work of getting your application compiled. Best of luck!
