Hi, I'm stuck on the I-864.  Last year (2015) I claimed my grandmother as a dependant on my taxes.  Do I count her on the I-864 now?   If so do I need to also sumbit a I-864A for her?  My next option is to file my taxes for 2016 without her.  I just want to send the AOS ASAP .  Thanks

The I-864A is for when a household member is joining their income to yours, like when both spouses work and they're combining incomes in order to sponsor someone. I'm assuming your grandmother doesn't combine her income with yours.

Thanks!  Where it confuses me is that I don't know if because she is part of my household I have to include her income on the 864.  She is disabled and receives SSI.

it is just information about her to see if your income covers all 3 of you. unless you need a joint sponsor, and her income is more than enough to cover herself and your wife, you don't need anything of hers

Does your income by itself meet the 125% poverty guidelines for your household? If so, she doesn't need the I-864A. Now, if your income is enough for a household of 2 but not 3, then you might need to consider not claiming her on your taxes.

My income is enough without her income.  Thank you very much!

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I'm stuck again.   Do I need to count my parents to whom I filed a I-864. About 14 years ago and no longer leave with me?   Do I count them as part of my household?  There is a question asking me to list all person I filed this form before.  Does that means I also have to meet the poverty guidelines for them as well? Thanks and sorry for the confusion

Confused again.   I read the instructions but im

stuck here.  Part 5 .   Person you are sponsoring on this affidavit.  1. My now husband.    Then it asks persons I am not sponsoring which is where I list my dependents however it's asking if I am married to enter 1 for my spouse. But entering one there will count him twice.

that is in case you were sponsoring someone else, such as a parent, sibling or child, you would count your spouse as married

 

but since your spouse it the beneficiary, you don't add him twice. leave space blank

If so you need to use the I-134 form.

 

And preferably 3-6 months worth of pay stubs. Bank statements to my knowledge generally are used it showing assets/savings, if so I believe statements for the last year(monthly ones).

 

I just used pay stubs do to good income, and a letter from employer, and 3 years of W2's from my company.
