April 2017 AOS Filers

So, how long does a case have to have been active before you can file the online case enquiry? In other words, what constitutes the normal processing time (it seems to differ vastly by location and is always conflicting from one source to the next)?

I've been on the 'case is ready to be scheduled for interview' since July 31st (filed during the last week of April). I live in California (LA County) but have no idea if that means I should be looking at the California service centre as a guide ( processing cases from April 2015?!?!?) or Chicago (where I filed) which states they're processing cases from November 2016.

My receipt number starts with MSC, so does this mean it's at neither of the aforementioned locations and is just collecting dust somewhere?

I'm so confused.

We had our infopass appointment today and it was really good news! The officer told me I worry too much (very true) and that Iranians are not taking longer than anyone else. He said our case is just waiting to be scheduled for an interview and there is a large backlog due to many applications recently. Our status has been on RFIE received since April and we have called and put a service request online, but neither time did they tell us any of this information.

We also asked about traveling internationally and what would happen if our interview is scheduled for a time we are gone. He said we can request a new interview if that happens. We have an international trip scheduled for January, I know others wouldn't risk it, but he has AP and the travel ban says people who already have re-entry visas are OK. We are willing to take the risk, I haven't heard of any Iranian spouse with advance parole being denied entry, but we will have attorney contact information in case there is an issue.

03-16-2017 Sent I-130, I-145, I-131, and I-765 renewal to Chicago Lockbox

03-20-2017 Priority Date according to I-797C

03-28-2017 NOA1 Text and Email notifications received

04-03-2017 NOA1 documents received in the mail

04-05-2017 RFIE notification

04-07-2017 Biometrics letter arrived

04-10-2017 RFIE letter received for birth certificate (that we already sent)

04-11-2017 InfoPass and mailed RFIE response

04-19-2017 RFIE response received by USCIS

04-21-2017 Biometrics appointment

06-08-2017 EAD/AP approved (day 80)

10-03-2017 Sent online case status inquiry for I-485

11-06-2017 InfoPass appointment about case status

12-05-2017 Requested case update from Congressperson's office

01-22-2018 Interview!! Approved on the spot

I think you need to be looking at the LA field office times. Since your status changed to 'Case ready to be scheduled for interview', I'm assuming your case has already been transferred from NBC to your local field office.

I think you can submit your SR online 180 days after your last status change (or maybe after you filed; can someone correct me on this?) for I-485. My status is stuck at 'Fingerprints fee received' and my PD is that of early April, so I was able to file the SR early October. Although it's a different story that it hasn't been assigned to an officer for review, yet.

Hi guys,

I just filled a service request. It's been over 7 months since I last heard from USCIS about my AOS.

How long does it usually take them to answer back?

AOS is taking up to a year so you have a awhile to wait.  They don't get back to you about service requests, i submitted two as I am still waiting for my work permit and im at 8 months of waiting for that which is "normal" so I was told at my Infopass appointment in Tampa this week.  Absolute joke.

Wow!! 8-month wait for work permit? That's a joke! I'm sorry.

What's the point of service requests then if they don't answer? LOL

Hi Mwar,

After how long should we contact our congressman? I haven't had any news about AOS since April 4.

I did get my EAD and AP but no news of AOS since April. It's been 7 months. No signs of interview or anything.

I don't think what's on the processing time is always accurate. At least it wasn't for me. I received the interview appointment letter; although according to the USCIS Processing Times website, I shouldn't have received it for a few more months.

Have you called USCIS? contacted your local Congressman? or made an InfoPass appointment? I hope they'll send you some updates soon. Good luck.

I stumbled on this article this morning "Marriage Fraud".

It is an article from Huston 2 published today. This goes on to show you that since there are some individuals out there hell-bent on taking advantage of the system, government is more vigilant and more suspicious of even most robust family based applications. Article also points out the fact that USCIS now interviews every single case of Fiance applications (K-1), which previously was mostly granted permanent residency without interview. This inevitably slows every case and delays our interviews. It is sad to note that actions of few bad people impact us all  in the most adverse way.
