No, some of the cases where the applicant is adjusting from K1 does not get an interview. Others do. It's random.

If it isn't difficult, it isn't worth it.

There's no indication that the Trump administration are making changes to K1 visas or adjustment of status process.

If it isn't difficult, it isn't worth it.

What gave you that idea? Are you referring to interviews for K1's or interviews in general? As A n' L said there is no such reason, indication or policy change to interview waivers even being considered.

 

Here is the link to the policy field manual that describes the eligibility criteria for interview waiver.

Being eligible ofc doesn't mean you will be waived.

I'm glad someone asked this question because I was wondering myself. My husband came through with a K1 visa, of course we got married, and did his AOS. About a month and half we got an RFE (the medical vaccines were missing), we completed the information and sent it back. We just got a letter this Monday that his status was approved and should be getting his greencard within 3 weeks. We are both confused because we were under the impression we had to go to an interview process and then they would determine if it's approved or not.

When it comes in his hand I guess I'll believe it....

Nope. The interview isn't required. Most K-1's avoid an interview simply by promptly AOSing and having fairly smooth cases during the K-1 interview. Sometimes it is random, but it seems that those who had pretty clear cut K-1 interviews ended up not having any AOS interview. They used to send letters stating that interviews would be waived, but then it would actually take longer for the person to get their Green Card due to paperwork. Now it seems they're just doing approvals on the spot and not sending out waivers at all.

With that said, my husbands AOS was approved in 77 days, it was even approved before his EAD and AP lol.

The instruction manual for CO's state that being a K1 filer should qualify for a interview waiver. However, quite a few filers (even with straightforward cases), do get interviews. I've noticed that almost every AOS case on VJ with local office Detroit ends up getting an interview, and fairly fast (4 months). I wish I knew why.

If it isn't difficult, it isn't worth it.

Part of it might be workload distribution... if cases are straight-forward and belong to an office with really long wait times It's possible that they are more likely to get fully processed at the NBC stage and waived. Being a K1 is just one of the criteria, another involves any other sort of concerns regarding identity or such issues that might have emerged along the way, or in fact just anything at all that they might find they want to inquire about, however small it might seem to the applicant.

 

I was approved at NBC stage and I would have belonged to the Dallas field office... and office with long wait times for interviews.

I agree with this theory. San Antonio was showing almost 250 days of wait time, but we only had 77 days of wait time for an approval.

Today we went for our marriage base AOS interview and CO says he approved us and you will get your GC in your mail, but he didn't stamp my passport, does anyone have an idea 

How it's gonna b work ?
