NC license while in AOS pending

Hi Guys!

 

Any experiences esp. from NC if it is possible to get a driving license while AOS is in the works? Am still waiting for EAD approval at this time.

 

Also, how many days does it usually take before one receives a notification from USCIS? They received my file 4days ago but haven't heard since.

 

 

 

Appreciate any thoughts on this!

Have you tried a Google search, or looked for fairly recent previous posts on VJ?

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Sorry, can't help with your specific question -- my wife adjusted from F-1 in NC so she already had a license there during AoS.

 

But in case you're wondering, I can confirm that in the almost 10 years she lived there, they were always sticklers about pegging the license expiration date to the expiration date of the immigration document (license needed to be renewed every year on the F-1, and then it was good for (almost) 2 years on the conditional green card).

There was a couple of posts related to this topic but none from NC, I figured laws differ from state to state so I just called DMV up, they told me they needed proof of my lawful stay currently, so I guess best bet would be to wait for EAD or AOS approval.

I came on a K1 visa and NC DMV said they will give me a state id or a driver's license only up til the expiration of my I-94. I chose not to push thru with the application and wait for my EAD card then I'll come back to DMV.

Hey! We're also in Durham. :)

 

We filed for AOS last week, took ~6 days to get a text message from USCIS (at 12:20 am). Haven't gotten the i-797 yet, but will go and try for a license when we do, as the 797 is listed on the acceptable forms for NC. Will let you know how it goes!

Thanks for the headsup @alexandaaron - I already received my NOA1 a week after I received the text message from USCIS so all in all I'd say it took 2 weeks from the time I filed the AOS. Next wait is for the biometrics appointment letter I guess.

 
Did try to have a STATE ID with my NOA1 but the DMV officer told me to hang on to it for the moment as they'd like the approval notice of I-765 to accept my application. Hope you have success though.

Ask them if they can run your unexpired foreign passport as the document of choice in their list and have them scan in all relevant pages of it, your expired or unexpired i-94, marriage license if you're the female and changing name, SSC and NOA1. I'm not from NC but I was in your situation in Texas, with the i-797 being on the website. I didn't expect it to go through cause I had been told I had to wait for the EAD from ppl here on VJ, other websites and by a lady at the dmv. I got the letter a week later that "lawful presence is verified". Went back did my tests and got my license. I don't have a "date" on any document and my i-94 was expired. The dmv gave me 1 year on the license. I have seen the same for VJ'ers in some other states but I'm not sure if NC was one of them. They all verify against the same federal database... so imo it's worth a shot if they'll agree to run your papers.

apparently they looked unsure of whether or not my unexpired passport, expired I94 and NOA1 were acceptable documents at the time-they kept on referring my papers to one another saying my stamp was already invalid as it expired 01/24. Might try in a different DMV location instead. I guess I did not want to risk arguing with them lol

yea they were unsure at my dmv too... lol 

you can ask them to please run it without trying to argue I think though :)

Were you able to get the driver license with just the notice of action?
