Filing and this year's tax return

Hello,

I have a quick question:

If we file for my husband's AOS in January of 2017, does that mean we will later have to provide 2016 tax returns? My father is a joint sponser and he never ever files before October (gets an extension), so there would be no way of getting it before then. Should we just try to file before December ends?

Hi if I was you I would file now that way you would be locked into 2016 tax frame. ROC is currently running very slow right now put it this way you file now you will automatically get a 1yr extension letter in the mail within 2weeks after you file

OP was asking about AOS, not ROC.

The earliest I can file would be this Thursday :-/ that would be on the 22nd - 9 days before New Years. Do you think they would receive and process my package before 2017 if I file this Thursday?

Don't base your filing date on tax return status. File with the latest tax information you have, and if you do get an interview in 2017 and have updated taxes at that time, then take them to the interview, otherwise, don't worry about it.

You mentioned you could file by this Thursday. Another item you want to consider is that on Friday (12/23/2016) the AOS fee goes up $155. Now I don't suggest rushing things, but if you can have the package together, it is something to consider.

I would definitely file before the 23rd. That way you only have to pay $1070 instead of $1225 once the fees goes up on Fri., the 23rd.

You send in whatever is your most recent tax return at the time of filing, which is still 2015. If you end up having an interview, and that interview is after the 2016 April filing deadline, then take your 2016 return at that time.

^^^ This!^^^ Save the $155.00 if you are ready to go. I just read in another thread that the "old" fees apply as long as the packet is postmarked before the 23rd. Good luck.
