As someone planning to file for naturalisation in a year that's on a right schedule, stuff like this is particularly worrying.

You'd still have to file suit in federal court to enforce the 120 day provision; it isn't automatic.

I wonder if USCIS still keep scheduling interview for IOE********** fillers? Particularly during this time of year, what would happen to those who have waited for more than 6 months for interview and now surfaces this damaging story?

I have an IOE case number and was just scheduled for interview on first week of January few days ago.

I am hoping they resolve this soon coz if not, they will have a huge backlog!! Just imagine the hundreds of people sending their applications everyday.

What about the applications that are filed in September onwards? If they get NBC, are they still part of Elis system?

Seems like the issue is specific to ELIS system and NBC may continue.

From what we know, the NBC case number shows that your application is not being handled via ELIS, and the report we've all read seems to refer specifically to the applications in the ELIS system with IOE case numbers (like mine, yay). We don't know for sure if this report will effect everyone (i.e. not just ELIS applications are somehow doing the background checks wrong/not at all) because it's only a single email without the full picture.

The best thing to do would be to follow your monthly application thread on the forum here and see if other folks who filed around the same time as you start to get interviews and oaths. As an IOE/August filer, I'll be following September onwards, too, to see if it's a complete slowdown or just the unfortunates in the May-September window.

Honestly, I'm not in a hurry to do the interview and oath, but I'm pretty peeved that they have, yet again, taken my "fee for service" and are failing to provide said service in a timely fashion (if at all, at this rate).

Remember, a 10 year GC can be renewed forever as long as you're maintaining residency, so don't panic folks.

Some people need citizenship for employment or other related reasons, which I could see being the biggest issue.

Hopefully this gets straightened out soon, but if experience has taught me anything it's that USCIS moves at glacial speeds, even when they're fixing their own mistakes.

I think they should transfer all IOE case to NBC as soon as possible, and give priority to these IOE applications and these people's nightmare.

I received a letter saying that our oath ceremony on Dec. 15 was canceled and would be rescheduled, I'm guessing because of USCIS's big screw up. Anyone have a clue as to when this would likely happen? Before Jan. 20th??
