I was told by a lawyer here in the US that my fiancé needed to get a CENOMAR in the Philippines to prove that she is no longer married from her two previous marriages there. She already had a document from the Philippines Statistics Authority that says their search yielded two most likely matches in the National Indices of Marriages. This document does not say that either one of those marriages was annulled or no longer valid. Because of this I had her go back and fill out the application for the cenomar again and they gave her the same exact document. Does this mean that she is still legally married to both of those people in the Philippines? How can she be married to a second person if she was still legally married to the first one? Our situation is very difficult because she has been an overseas worker in Japan and that was the reason for her marriages-they were an arranged marriage for her to work in Japan.

I'm not a lawyer or anything but I can say that yes she's still married to those 2 men. Even if she married them both in Japan, if both marriages were reported then most likely those 2 mentioned in the PSA are hers.

How can she be married to a second person if she was still legally married to the first one? - It could be getting married in Japan does not require a CENOMAR. She could be sued for bigamy.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

If the two previous husbands initiated the divorce aganst you you can some day register them at PSA to corret your CENOMAR. in the mean time you need your divorce certificates and the current CENOMAR for the interview. The divorce certificates will trump the information contained in the CENOMAR which is not a problem with the CO during your interview. More information can be found here.

The lawyer is correct, sort of.. :time: with your timeline being void it is difficult to answer your question.

For the I-129F petition process you do NOT need a CENOMAR, but you do need copies of her divorce/annulment

For the visa process in the Philippines you will need the CENOMAR and copies of the divorce/annulment documents.

Still lots of unknowns with your question. Was she married in the Philippines or a foreign country? If married in the Philippines she will need to have completed the annulment process + have the certificate of finality that was recorded with PSA. If married in a foreign country she needs copies of the divorce decree (in English).

Married twice --- TIMES 2.

Being PSA is not issuing a CENOMAR nor annotated CEMAR (certificate of marriage) it would appear there is an issue

She married both of those two men in the Philippines and then she married them in Japan when she got to Japan. We do not understand how she could have gotten married for a second time in the Philippines if her first marriage was still valid. This is what we are trying to figure out.

Yes she is divorced in Japan. She got married to her first husband in the Philippines, then she got married to him in Japan once she got to Japan. She then got divorced in Japan, went back to the Philippines and got married to the second person. After that she went back to Japan and married him in Japan. We are confused how she got married to her second husband in the Philippines if she never went through an annulment process with her first husband in the Philippines.

Yes she is divorced in Japan. She got married to her first husband in the Philippines, then she got married to him in Japan once she got to Japan. She then got divorced in Japan, went back to the Philippines and got married to the second person. After that she went back to Japan and married him in Japan. Yes I know we have a lot to sort out. This is what we are working on. I will meet with a lawyer at the end of the month to try to figure out what exactly she needs. I was just hoping for some answers to if it is even possible her to get married again if she is still married. She worked as a hostess in a nightclub in Japan and had to get married to go work there- it was not a marriage she wanted, but did it out of necessity to take care of her family. Now we are trying to clean up the mess.

I know what you meant but she's not the only one I've heard with the same situation in the Philippines. With the right connections and "under the table" transactions. There's also such situations that a guy marries a woman using another person's CENOMAR, and again sample of right connections and under the table transaction.

When you said "we" don't understand on how could she have gotten married the second time, you got me confused there.. your fiance should have known since in the first place she's the one who got married and went through all the process. She couldn't be that clueless, if you know what I mean.

Married twice = She needs two divorce decrees/annulments How she married twice in the Philippines without obtaining an annulment is very suspect.

Lots of red flags ..
