Help: Unknowingly committed visa fraud (split and merge)

Hey Guys after reading a few articles I realized that I might have unknowingly committed visa fraud.

Here is my situation- I met my husband on my previous visit to the US we date for 4months before he asked me to marry him. I went home for about 5 months where we planned our marriage, we decided that it would've been a lot easier to marry in the us because it would be a lot cheaper than to fly his entire family in for the wedding and we wanted a simple wedding with just a few guess. So the plan was to get marry return home and file for a spouse visa. After arriving his mom advised that we filed for the marriage license immediately because he only got 2 days off and that was the day I was arriving and the day of the marriage because of his busy work schedule. So we went straight to the marriage registry and got the license. That same week we learned that my mom will no longer be coming because of a family emergency, My nephew had been in the hospital for momths and now was in a very critical condition. So we decided to cancel my flight back home and canceled our marriage arrangements and wait for my mom, but that didn't work either because her trip was cancelled indefinitely because my nephew later died in the hospital. So we decided to go directly to the registry and marry then I would return home. So we did exactly that. This is approximately 20 days after obtaining the marriage license. On the day we decided to buy my return ticket, my husband got really agitated because he knew that we won't see each other for about 6 months while we await my spouse visa. So he spoke to a friend who told him that we could file for Adjustment of status while I was here. So we inquire about it and decided that I would do that. Approximately 67days after marriage we sent my AOS package to uscis and after doing so I later found that I will not be able to travel back home during the process. ? so as I await NOA from USCIS I'm worried that my GC will be denied.

Any advice?

Assuming you did not lie to the CBP officer when you arrived (and there's nothing you have said to suggest that you did) there will be no problem.

Yes, it's true that you cannot work or leave the country for a while.

There are many reason your adjustment of status can be denied. What you have described is not one of them. That doesn't meant it's guaranteed. Like the spouse visa process, it can be denied for other reasons such as no evidence of bona fide relationship, etc. But you don't need to worry that you entered as a tourist, got married and stayed. That's perfectly acceptable.

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

Assuming you did not lie to the CBP officer when you arrived (and there's nothing you have said to suggest that you did) there will be no problem.

Yes, it's true that you cannot work or leave the country for a while.

There are many reason your adjustment of status can be denied. What you have described is not one of them. That doesn't meant it's guaranteed. Like the spouse visa process, it can be denied for other reasons such as no evidence of bona fide relationship, etc. But you don't need to worry that you entered as a tourist, got married and stayed. That's perfectly acceptable.

Except I just realized that I failed to mention that I cannot recall what exactly I told the CBP officer but I'm assuming I told him I was visiting. Didn't know I was supposed to mention to him about my plans...

Sigh, should consult an attorney?

It sounds like you had the right intentions. You said you planned on going home and filing for the CR-1, but plans changed with all that was happening to you at the time.

You guys made a change of plans again to marry and file for AOS. I think you'll be okay honestly.

Thanks you for this, I was so confused. But I'm not worried about proving that we have a bona fide marriage because we do everything together. We have joint bank account, credit card, vision and dental insurance as I cannot get medical insurance without being a usc or a GC holder. All this was included in our package to USCIS along with pictures documenting our relationship and we are currently apartment hunting and both our name will be on the lease agreement. I'm hoping all that will be enough evidence......

You will be fine. It was spontaneous and not intentional.

A word of advice though, do more research on the proper steps and let your hubby join you so you won't have any more worry attacks.

My husband and I had something similar happen to us, and all went fine. My husband now his his 10 year greencard and life couldn't be better! Good Luck to you both. As others stated, just make sure you don't leave the country before getting your AP (if you applied for it) or Greencard in hand :)

My husband and I had something similar happen to us, and all went fine. My husband now his his 10 year greencard and life couldn't be better! Good Luck to you both. As others stated, just make sure you don't leave the country before getting your AP (if you applied for it) or Greencard in hand :)

Wow. Would you mind sharing you experience with me? I would feel my better knowing that someone else was/in the same position with me and got through without any problem... ?
