Unless you didn't intend when you entered and decided to stay and adjust later on, which is also legal. :)

Hello again,

Finally my EAD status has changed to "New card is being produced" this morning. I am adjusting status from F1 Visa. I sent my documents on 2 of November and they received on 7th of November. Anyway, how long does it take to get a EAD in hand after it is being produced? PS. I have put on USCIS service request 02/02/2016 as @Suss&camm suggested me to do and my status changed a week after i did it.

Thank you

I wanted to let everybody know that I got the letter from the DMV today and my lawful presence is verified. Yayyy! So tomorrow I'll go take the written test :D

This means that the NOA1 from AOS is an accepted document! Cause my i-94 is expired and I haven't yet gotten my EAD. I should have done this ages ago, instead of worrying so much.

They don't allow me to get a DL. I need to wait for EAD or I-797A.

well, every state takes this differentlly! but in some states like Cali or AZ, it's enough to prove you are doing AOS to give a year driving license!

even if you are I-94 is expried you still can use your NOA1 for AOS to get a driving license. I just did that 2 weeks ago, it worked good with no hassle!

if the person by the front dest disagree with you, ask to talk to the supervisior or the boss and explain your situation that you are doing AOS and you don't wanna drive without a license!

all the best!

Well, here's the thing! Different states have different requirements for getting the license, yes. All of them however need a document that will work for verifying lawful presence. The requirement is that you are lawful! If you have all the other documents it shouldn't be a problem. I realize that getting them to actually run your papers is another issue, but if you CAN get them to run all your papers including the NOA1 it will come back as you having lawful presence cause that is a federal database and they all use the same software. They didn't want to run mine either at first. I had brought some printed papers indicating that my presence is lawful so she pretty much indulged me.

The documents she scanned were:

Passport - biographic and VISA page
SS card with maiden name

Marriage certificate - I applied for license in my married name

NOA1

expired i-94

the document number used for verification was the unexpired foreign passport in my case. Everything I had heard about this previously in Texas (and I did a lot!!) of research pointed towards me needing the EAD, but it turned out I didn't. I just wanted to let you guys know in case someone feels like giving it a go.

We spoke with the highest rank person on the DMV and told us the same. They can use I-797 but not this one, we need to have I-797A not the I-797C ( NOA1 ) . so i need to wait until I get the EAD and after that they would give me a permanent DV (  4 years ) . The same thing I was told 3-4 times already by other DMV's. So...if someone in Chicago IL can do it i really want to know where and how lol.
