I am a US citizen with a permanent address in TX and a US passport. 2 years ago I moved to Serbia when I got married to my Serbian husband and am currently still in Serbia on a Serbian visa. I am a depended in America of my parents on their tax returns (and obviously dont have a job in America). I am planning to send a I-130 (will send to my parents in US who will send to lockbox) for my husband for a IR-1 and am wondering which address to use when it asks for my residential address, mailing address etc? I do plan to return to my US permanent address with my husband (fly to US together) after he gets his visa.

Or does anyone have any other advise for my situation? I am a bit scared that this situation will cause some problems in the visa.

Use your current residence as your residential address then use your parents' as your mailing address.. You will still have to prove domicile intent.

Use your current residence as your residential address then use your parents' as your mailing address.. You will still have to prove domicile intent.

If I use their mailing address everything would be mailed to them... which i dont think would help much. But thank you for your input!

But since you are outside the US at the moment, wouldn't make sense to have it mailed to your parents who can scan and mail to you until you move back to the states?

If you provide an address that you can't receive your mails from in timely manner, you will have yourself to blame.

Why would I not be able to receive mail in a timely manner in Serbia? It seems like it would take more time for them to send to my parents and then my parents to send to me. Idk? Thank you!

You can file it with a foreign address as your mailing address. That shouldn't be an issue.

However, having this happen to myself, don't be surprised if some of the notifications don't show up. My NOA1 never did.

I know we are expats from different countries. We are not in a hurry to rush back to the US.....But if we were, we would have "filed from abroad" I noticed cases from Ukraine getting NOA2 in 60 days.

I also have a US address, but I was a little concerned about domicile. I have US bank accounts and I keep my taxes current. I attended interview with my wife. Domicile wasn't even brought up. A few questions about my investments were asked because my tax transcripts show negitive income.

Our journey has been really easy and we stayed together the whole time

10/7/15 Entered USA for three weeks to close escrow and pack house

12/5/15 Entered USA for 90 days to visit

Wow congratulations!! Thank you for your advice, we will definitely sent directly to Chicago. I do need to prove intent to establish domicile in America when we send in affidavit of support. Unfortunately we both dont have a job overseas, dont have property or even bills in our name (since we live in the apartment owned by his parents), no American bank account etc. So we will definetly have to be creative when it comes to that.

If I could give you some valuable advice, it would be to start your next step and work on I-864 once you have mailed I-130. Make sure you copy all of your I-130 package.....When we got the check list of stuff to send NVC, most of it was already sent to USCIS. So we burnt copies of copies and sent them to NVC and added a little more relationship evidence....easy peay... I-864 was not so fun....for us it was a lot of information to gather from abroad.

you will need cosponsor and as your parents have you on income tax returns, it would be them to sponsor you and him (of course with their approval)

for 4 in household they need to meet $30375 annual income to meet the 125% poverty guidelines / it goes up, of course, if more are in the household

you need to look into the total costs of the visa and make sure you know all the costs
