Confused :-/ can I start process in US on travel visa?

Hello everyone.

This is my first post, sorry if I’m asking silly questions, but I’ve tried looking for answers on here and everywhere and a lot of things are unclear for me.

My husband and I got married in January (03/01/2016) in Hawaii. I am a Polish passport holder, born in Germany, living in London,UK for the past 10 years. My husband is a US citizen. We meant when he was studying here in the UK. We have been together for two years, the first year he was living here in London and for the past year, he has been bouncing back and forth between London and the US.

We are now planning to make North Berwick, ME our base. Since I no longer want to stay in London and obviously want to be with my husband, is there a way to go to Maine, and file the petition from there? If so,

Q1 what do I tell the immigration officer at the airport? Usually I am visiting family/friends and returning back.

Q2 do we file the I-130 and I-485 which will be the adjustment of status, the entire solution/answer?

Q3 I-765: can this be sent at the same time? Since being able to work will be very important to me.

I am looking to move mid Dec (worst time of the winter in cold Maine ha).

What you are planning is immigration fraud and will get you a lifetime of not living in the US.

This is exactly what I wanted to clarify.

So there is no way of doing it through application in the US? The ''adjustment of status'' is what is confusing me.

In no way do I want to commit immigration fraud!!!

Once the I-130 is filed, how long will the process take approximately until I am allowed (legally of course) to enter the US and be able to be with my husband? From receiving the receipt of confirmation?

I am planning on leaving London end of November, to visit my parents in Germany, so will not have a set place to live.

You can file for the petition and still visit the US on the VWP, just don't stay longer than 90 days.

There isn't any problem with visiting the US during the petition process, the problem on lies in adjusting your status on the VWP.

The CR-1/IR-1 visa usually takes about one year. But you can visit your husband during that time as long as you don't overstay. The final interview/receiving the visa will be done in your country of residence, so I'm assuming Germany in your case?

The purpose of the VWP program is to allow citizens of participating countries to come to the US, without a visa, for tourism or business stays of not more than 90 days. It would likely be considered immigration fraud to attempt to use the VWP program for immigration purposes.

As I have a Polish passport, I have a 10 year travel visa (which runs out next year) I guess in the meantime while the process for the CR-1/IR-1 is going I will apply for another one.

Another silly question, can I visit for 90days, come back to Europe for lets say a few weeks and then go again for 90 days?
