Hi, just one quick question guys! We still have to submit our AOS to the embassy during my interview next week. So the situation is, 2013 and 2014 my husband's total income is above the poverty line but his income last year (2015) is very low since for the last 5 months he has worked here in Kuwait and did not include what he's paid for in his tax returns. This year, he's back to the US and his total annual income should pass the line. In this case, do we still need a joint sponsor or could we just submit a letter explaining the situation? :unsure::unsure::unsure:

Lol relax it would be fine. I intend to surprise my husband of the result so I wont tell him the exact date of interview that way he wont be nervous waiting lol

We wanted to get his mom to be a joint sponsor but she doesn't seem to care and we have an interview in a week, so I'm just worried if this will work out with us, even though his last year is alright but previous two are way below the line..

I've read somewhere that somebody got denied because of it..

That shouldn't be a reason for denial. Maybe someone can confirm that for you.

I864ez serves the same purpose as i864 however i864 is longer and for some harder so people dof i864ez. However with Ez there are 3 conditions: if the petitioner is the only sponsor and you are the only one migrating and petitioner is the one using his or her income.

You can explain with paystub or employer letter for current income and that should be okay.

I have mentioned this before somewhere but I will say it again here. If your spouse current income is above the line and is able to support you then they need to show with pay stubs from last few months or employer letter showing annual income or it can be both for stronger case and you may want to explain in a letter why the current income is higher this year such as new job. That should be good.

I had my brother do this for me and the case was completed without any problems.

I am hoping the embassy is okay with it as well.

All yo can do for now is add your IOE receipt number to your cases on uscis.gov. Once your card goes to production you will get text and email. If you sign up for it.

There's no other tracking before that at all.

Yeah I know. I'm sure I've read about this somewhere but since I'm in a kind of panic right now with the sudden turn of events I just then decided to post my question! :D

The thing is this whole time we thought we'll gonna need a joint sponsor which my husband's stepdad is willing to help. This entire time we thought that my husband's annual income is $300 less than the limit to support 3 members, not until he opened the employer letter which showed that his income passed the guideline which came as a relief but left us with this question too.

No good news. Got a 221g to bring more evidence of our relationship. We were separated for almost two years during which I did not visit or call, but on 2014 we got back together and restarted the whole process. I had started a petition back in 2011, when we got married, but he wanted to finish school and I wasn't ready to wait. The officer didn't believe that story...so, ready to keep waiting. Problem is the medical expires in December 27. :/

Interview today. Got a 221(g) for additional evidence of our relationship. I had started a case back in 2011, which was closed because he was not ready to leave the country at the time. We separated for more than a year for this reason, during which I did not visit or call. We got back in touch in 2014, and decided we still want to be together.

I have visited several times since then. Our relationship is as real as it can get! We have pictures, emails, phone calls, money I have sent, etc. from before our separation and since we got back together. We met when we were both children, for God's sake. Sorry for the ranting... I'm so out of it right now.

I believe NVC asks for copies now, not the original ones. check your letter.

So there is no easy answer to this, the best you can find is under embassy reviews. Some CO's will ask and some will not, it all depends. For pakistan, there have been people reporting that they didn't ask for AOS but there were some who did ask. It also depends on whether they loose a document so it is best to take copies of AOS documents. I am for my hubby along with pay stubs and such.

Is his current job above the %125 to support you and him? If yes then you need to provide information about his current job with either pay stubs or employer letter or both to show how his current income is higher than last years or in your case his new job is better and enough for both of you. It doesn't matter if he has worked on 6 months, they are looking for calendar year income information. I had a co-sponsor, meaning i had i864a with me and my brother to show the support I will be getting for my husband and my brother just started his new job this year so I had him produce his paystubs from 4 months to show the current income. It worked. my case was approved and is now at the embassy. also my brother's last 3 years' income was not what the demand is but it doesn't matter since they look mostly into current income.

If your husband is providing for you and sponsoring you alone, it will be best to do i864ez as it is easier to fill out than doing i864.

As of what date will you be doing yours? The current date or as the date it was when it was sent to NVC?

I don't think it really matters since the information hasn't changed (well, at least for the Affidavit), but would you submit your recent paystubs or a copy of the ones sent?
