Case lost after NOA2

We asked to expedite, instead they treated our case extra long and now giving us nightmare waiting time cz they seem completely lost the case. And nobody knows where our case is. NVC never received our case and USCIS told us, the case was sent. NVS answered us "NVC will work with USCIS to determine the location of your petition." USCIS is searching our case too. It's been about two months that theres no news after NOA2.

Senator is involved now, we are calling every day to both agencies, but my question is, is this a common thing? What are common reason something like that happens? Does that mean they revoked our approved petition?

A few years ago the California office was flooded by a broken water pipe and our documents were completely destroyed along with many others

They never informed any of us or acknowleged that it happened / found out thru my senator

and yes, cases get lost or come up missing deocuments

and others who have asked for expedite do seem to be delayed / another office involved and additional paperwork

My NOA2 was approved on April 7,2016 and was valid until Aug.6, 2016

It was NEVER mailed to NVC. It took me until June 21 to know that it was sitting in an offsite storage location.

I called weekly only to get different answers and promises that they will request the file and expeditiously send to NVC. That never happened!

My file was in storage for 4 months before it was ever sent!

It was only after I got my state rep involved did it get sent. I was given an new NOA2 August 5.

After that it has moved quickly, we have our interview on Oct. 3.

hope they approve your visa right aways and will not put you on Administrative processing or stuff like that. Good luck!

there a re people who's case was never found and they have to reconstruct everything and re-approve

I'm piping in because I've been there (recently). The nightmare appropriately named, USCIS, is real.

We filed our I-129F on 04 April 2016 and didn't receive an approval until 07 July. What should have been a 7-10 day transfer from USCIS to NVC turned into a near three month horror story. Passing days turned into weeks. Passing weeks brought no answers. Soon, a month had come and gone without NVC receiving our packet. And then another month came and went. Tension was high. My personal life and work life suffered as a result. I wasn't sleeping at night. I was barely functioning during the day. Daily calls to both agencies yielded nothing but scripted responses and apathy. USCIS blamed NVC. In turn, NVC blamed USCIS. Nobody wanted to take responsibility for our apparent missing documents (almost four hundred pages) and I was stuck in the middle to suffer.

After a long and insufferable two months (post approval) I pulled in my congressional representative's immigration liaison team. That also proved to be a worthless endeavor. The liaison representative did nothing for almost three weeks. Between vacation, time off for a Muslim holiday and what she called, "problems with the database", we were no closer to finding our lost documents than when we started. I was quickly losing hope. She (the immigration liaison) started making excuses and blaming her contacts at USCIS for the lack of answers. i.e. (They are busy. Their computers aren't working. They are away at a conference.)

And then a week ago, lo and behold, NVC suddenly had our packet. A mid-evening call to NVC revealed that our petition had arrived that day and a case number was already assigned. There were no answers beyond that. There was no explanation as to where our petition had been, or why it had taken over two-and-a-half months to travel from the California Service Center to NVC in New Hampshire. Honestly, at that point I didn't care. We had what we had been waiting for.

So, with all of that said, there is hope. Do yourself and your fiancé a favor and believe. Ride on faith. Encourage (her / him). Remain strong for each other and be positive. Call NVC every day. Start calling USCIS and requesting a tier II officer. Above all, don't attack them. Be calm, express genuine concern and ask for their help. I found many times that such an approach made a huge difference in their response to me. Imagine how many hundreds of calls they take each day from irate, frustrated and desperate people. Your calls should be different. Make your calls for help the ones that stand out.

Here's to hoping good news comes soon. Fingers crossed and prayers on the way. I promise. Keep us updated, please.

I appreciate the kind words, but its about YOU now. We will rally for you and continue to encourage you through this. I never got around to answering your questions.

You asked if this was a common occurrence. From what i have read and experienced, the answer is both, yes and no. Obviously the majority of cases move along with little to no issues, but there are far too many that don't. More frustrating is the lack of help, sympathy and respect offered by those involved. My congressional representative said that there are over one hundred cases a week that just go missing with no explanation. Even one is too many.

Reasons, you ask? Who knows. I've heard everything from cases being thrown away, petitions being misplaced, documents sitting in desk drawers for months at a time, to entire batches of cases being sent to the wrong agencies. Once you factor in laziness, apathy and an incredibly inefficient system, reasons for lost cases grows exponentially.

There were a bunch of cases in recent years that ended up being sent to a storage facility rather than NVC. Maybe your case is among them? Your immigration liaison through your congressional rep should be able to clear this up to get NVC, respectively USCIS, to retrieve the file and get it to the right place.

Something strange happend with us yesterday too. We got Noa2 aug 24, and yesterday called to nvc to find out what is going on with our case. Operator asked my name, case number from USCIS and birth date. all we heard is that they dont have such birthdate in this case file. In belarus we use dd-mm-year format, so we tried it all and still answer is the same. they can not give any information coz they have different birth date in file. i checked one more time all forms and everything matching. Even if it mistake in format of date (dd-mm-year instead of mm-dd-year) they still tell it is wrong. i wrote a letter to nvc and about our case status yesterday but we wait for result and our next steps (well it is weekend)

зубер, keep calling and maybe another officer will enter it right, i remember they enter my name wrongly into the system, it took them 10 days to correct it

08/01/16....NOA2 approved

WAIT/CALLING TO USCIS.. WAIT/CALLING TO USCIS.. WAIT/CALLING TO USCIS.. WAIT/CALLING TO USCIS..CONTACTING USCIS SUPERVISER..CONTACTING SENATOR..

10/03/16....Case sent to NVC (THEY LOST OUR CASE AND STOLE 2.5 MONTHS OF OUR HAPPINESS. Only senator's involvement helped to sort it out.)

10/13/16....NVC assigned case number (after waiting more than average)

WAIT/CALLING TO NVC.. WAIT/CALLING TO NVC...WAIT/CALLING TO NVC...LOSING MY MIND AGAIN..

11/16/16....NVC status changed to IN TRANSIT. Yay!

11/20/16....US Embassy received file but never contacted me

11/26/16....packet 3 received by consulate (packet 3 instructions was never sent by embassy, I sent packet 3 regardless)

11/28/16....interview scheduled on 12/22/2016

12/22/16....CO refused to consider self-earned income and refused co-sponsor. Refused to take in consideration my own assets and property income and well established freelance business. Asked to show $100K++ on bank account while he knew that we have maybe only $70K cash. 

03/22/17....After several fights was interviewed in Paris. They kept my passport. Was told Administrative Processing won't take more than 2-3 weeks.

зубер, keep calling and maybe another officer will enter it right, i remember they enter my name wrongly into the system, it took them 10 days to correct it

Thank u for nice words. We going to try again. One officer told us to email them letter with copy of my passport to fix everything. Hahahh, we all have to be strong and patient =) Good luck for all of us
