ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

Hmm..I think I am following you guys..so that mail from that informed delivery is not biometrics but this info.  Any idea how many days "Expedited" means?  Tsk tsk tsk I am feeling i have to push my "fly home date (July 1st)" again :crying:.  So, at this point, we can't use the Stamp right?  It expires in September.  Somebody was so right that in America, its very beneficial if you become illegal :angry:

Of course you can use the stamp. It expires when it expires. And I dunno about you but I'd take having LPR status over being illegal any day lol. 

 

I haven't received anything in the mail other than an NOA1 for the I-90. My biometrics notice is on myuscis. The service request response was via email. It's going to be OK, they will sort this out.

I did not file any type of i-90. I did an online Service Request through the DHS website for 'Typographical Error'. The email that I received today does not state anywhere that I need to file an i-90, just that I return the Green Card to them with a covering letter describing the error, and mark it to be expedited. It does not state how long the expedited process takes - However I will come back here to update once I receive my corrected Green Card.

 

You may have received different instructions if you filed an i-90 for the error (my apologies, I don't have time to go back to look at your specific case or timeline to see what your situation is). Part of the i-90 process is new biometrics - I also read that the biometrics should be waived if the error was on USCIS. This is just stuff that I've read along the way of course. Maybe submitting a Service Request online, would be a good option - You may get the same response that we did, and then you could withdraw your i-90?

 

P.S. Always better to be legal than illegal, no matter the delays! :thumbs:

Uh!Oh!  I thought I-90 was the only way to go.  So that mail must be the biometrics.  And all articles says i-90 processing takes approx. 6 months, hahahaha.  (Pats myself on the back, well done!!) Long Breath...It's okay now, we have waited so many months, this remaining days will go in a ziffy ;)

Did you file for n-400? I hope you get a good response. Ask for tier 2. 

I know I'm still in for 6 months wait due to n-400 in Seattle. However my case has just made it there so hopefully my 12 - 15 months doesn't start from now.

I filed an I-90 along with doing the service request. I have biometrics scheduled but I won't be going to it now that I have better instructions that won't cause a 12 month wait lol

You should DEMAND the lawyer to help you with RFE without additional fees, the reason you received  RFE could be that the initial file was done poorly, otherwise there should be no questions. But I also think that since the process of  I-751 approval  takes longer now they might send RFE just to make sure you're still married and live together and all this stuff. So you might want just send the same papers but up to date and they will send you the card! :)

It seemed like they didn't prepare the package correctly....they only advised us to submit 6 months worth of evidence! I could have demanded they work on the RFE but honestly didn't want to risk it. To them it's just $$,  to me its my future :) so we took it upon ourselves to respond.

just a question - do i still get the green card even though my n-400 is in the process? i could not find a specific answer to this or maybe i'm searching the wrong blog...

i filed the n-400 right before the 90 expiration of my 2 year temp gc...

I am in the same situation. After my research and speaking with Tier 2 offices as well as with officers in my local Tampa Office, we will not receive a green card. We will have a joint interview for Removing of conditions as well as the Citizenship test the same day. The first interview is with your wife or husband ( the petitioner), asking typical questions about marriage and stuff. Second interview  ( that same day) is the Citizenship test.
I am still waiting to be scheduled for an interview.

We had both on March 12 and we're still waiting. They mentioned an IT glitch within their system that prevents them from approving our I-751, and therefore moving forward with approving the N-400 and scheduling the oath ceremony! LOL I know, pathetic!

F-1 Visa: Academic years 2007/2010.

K-1 Visa: I-129F sent Aug 2013; Approved Jan 2014.

Green Card: AOS sent Feb 2014; Approved Jan 2015.

Removal of Conditions: I-751 sent Nov 2016; Approved Apr 2018.

US Citizenship: Application sent Nov 2017; Fingerprints Nov 2017; Civics/English exam March 2018; Oath May 2018.
