Affidavit form Vs Evidence of Living together.

Me and my wife is having problem filling out affidavit of sponsor form she is 19yrs Old am 19 too she asn't file tax on her own in the past years her Mom filed her to her Tax,now we don't know if we should put zero income in past years and write a letter of explaination or if she as to ask her mom for tax returns,Secondly we both live in her Moms house and we not on the lease what can we do to prove along with our paperwork that we stay/live together with her mother is there any form or letter her Mom as to fill or sign.?

Just so that we are all aware. Are you in adjustment of status stage. I know that is where you posted, just want to clear things up and what visa are you adjusting from. If you could please fill in your timeline that would be great. so from what I gather you are having problems with I-864? If so, and you are not working then you need to have someone else sponsor as well. Make sure they know that if your wife becomes a public charge that they are a party held responsible for paying back the government unless she becomes a citizen. At that point there is no more need for a sponsor, but that is about 3 years down the road.

Yea my spouse is adjusting from B2 we already have a joint sponsor just worried about evidence of house lease and me not filling tax return in the past,what do I do?

You can write a short explanation that you did not file tax returns because you were claimed by your mom.

If you have income, you need to list it, even if you didn't file taxes.

She can simply write a letter stating that both of you live with her.

If she worked then she needs to file taxes in most cases, even if she was claimed as a dependent by her mother.

@harpa how do we get a tax return even if my spouse was claim as a dependent by by mother and she as income.?

She'd have to file her taxes for those years first. She can back file. Was her income over $ 10,000 per year? I think that's roughly the filing threshold for a single person (assuming she was still single those years).

If she was single and her income was under $10k she does not have to file.

Was single those years just got married a month ago and made under 10k past years,but was claim as dependent by Mom.
