What was the hearing for today, I thought you were going to get your decision on the NOID. Obviously I got that one wrong, looking at your timeline I guess it was a further removal hearing that you went to today.

Where do you go to hear about the NOID.

How long might it be before you get your EAD you must be going out of your mind!!!

Hi there,

Yes the NOID and removal hearings are two separate things. The removal hearing came about because my ex didn't go the AOS interview. Because of this I have had to ask the IJ more time to get my VAWA petition adjudicated- and now have a NOID to deal with on top. If my I360 had been approved then so would my EAD have been. It's mutally exclusive deal. I don't have a hearing for the NOID- I just have to reply to the qustions they have asked me and submit even more evidence to support them. this is dealt with through Vermont.

shona i am really so sorry to hear what you are going through ,hang in there dont give up hope you will make it iam sure ,i can feel you because iam going through an abuse too but i dont trust the immigration you never know what they do ,iam just being patient ,i have my CGC and waiting to remove it next year because i dont wanna go through all the Sh...,go there comehere do this bring this wait come back ....its a stress i wish you luch shona and i have a feeling you will make it ,i trust my feelings .

Great news for the extension . . . another thread of hope. Glad that the judge was at least sympathetic and didn't treat you like a immigration number. Good luck and continue to stand your ground.

May 10th I-130 Packet and Packet 3 sent off to me by the U.S. Consulate
May 16th -Received Packets 1-3 from the U.S. consulate
June 29th -I arrived in Puerto-Rico!
July 2nd -Married in Mayaguez, Puerto-Rico and also got our interview date for September 6th
August 17th -We arrived in Australia to file for Sep. 6th
September 6th - Filed DCF in Sydney and approved 1 hour later!
September 12 -Received my passport with the visa and yellow packet
November 24th -POE.......Guam,USA
December 12, 2005-Green Card arrived in the mail
September 11, 2007 -Filed I-751 on conditions
September 17 -VSC Receives my I-751 and issues NOA1
Oct 10 -Had biometrics taken in San Juan, Puerto Rico ASC
Oct 12 -Touched.
Aug 21, 2008 -Approved!...........finally
Sep 17, 2008 -Mailed off N-400
Oct 22, 2008 -Biometrics taken in San Juan ASC
Feb 12, 2009 -N-400 Interview

Just an update .Spoke to my attorney this morning. First she said that basically my original petition was poorly put together by my first attorney to whom I paid over $3,500. We discussed a few things and she said that I probably have a 75% chance of the NOID being overturned. I'm angry that my original attorney may have cost my case, since the pro bono attorney said that she would have taken a different stance and my case would have been approved.

If anyone has to go through this with VAWA , and I've learnt my lesson,go to a Catholic Charities organisation. They know what the hell they are talking about!!!!!

Well, let's hope you'll have a positive outcome, but this post reminds me to reiterate that when "shopping" for an attorney, even an immigration attorney, bear in mind that one should ask what his or her area of specialty is. The area of immigration law and procedure is vast and complex, and just as with other disciplines, a doctor practising podiatry is a medical professional and he might very well understand the manner in which a brain operates, but I'd sure not want him to perform brain surgery on me!

Well I've done everything I possibly can to get all the evidence requested (and more) for my NOID. I'm finally driving up to Kalamazoo to see my attorney and give her all the paperwork. She'll be sending it off tomorrow. Fingers crossed...... now more waiting.

My attorney wasn't exactly sure-maybe up to 60 days. I guess I'll have to see what the receipt notice says. Even if it is approved (she's now giving me an 85 % chance ) I can't AOS until November in front of the IJ. That will be over 3 years since I've visited home :(
