WOW! I just looked at the processing times for Form I-751 as of June 30, 2016. The California Service Center is showing 6 months and the Vermont Service Center is showing August 31, 2015.

All I can say is those of us that have to file with the Vermont Service Center are getting the proverbial SHAFT. There is NO EXCUSE for this inequality between service centers. We don't get to file until November, so hopefully things will change, but I am not holding my breath.

Im sorry if this has been asked before, but 6 months... does that mean that it will take 6 month from the time they receive the file to get a response? I am about to send my I-751 but my green card expires on September 5th. Does that mean that I will be without one until the end of the year?

lesthatsri: No. Once you apply for the removal of conditions on your PR, your CPR status will be automatically extended for one year. You'll receive a letter to this effect. They won't send you a new green card for this one year. But whatever you need to do that requires a valid green card, your old green card (possibly expired already) together with the letter should be enough.

I think they do transfer some I-751's from Vermont to Cali to somewhat equalize the processing time. But it doesn't seem to be helping very much.

Thank you for responding so fast lyzdude I was about to erase my post, because I went ahead and found the ROC facts in the forum. But thank you, I almost freaked out. I was planning on going back to my home country for the xmas holidays for this year with my baby and my husband. But i dont know if I could have a problem to get in and out of the country. :/ I just came back from Peru in June, and I had to go through the long line, as my green card was close to expiration.

You will get a one year extension letter effective when your 2 year green card expires. Yes they are very slow. If no RFE or interview you can expect a wait from 6 months to a year. If they would run our government like a proficient private company, they would hire more employees and open a few more service centers to handle the work load, I feel the reason for the long wait is because they want to remain under staffed, if they were paid by the case they would move faster, and the background checks does not take much time, I have 3 concealed weapons permits from 3 different states and when I renew takes them 30 days to approve going thru the FBI , local and state law enforcement. So I feel if they would hire more staff, like any other successful business, we would not have to wait for a year for this process to unfold. Good luck

A year? I wish... My I-751 was signed for at Vermont 15 months ago this week.

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

This is so messed up.. How come one service center processes in six months, and the other one processes in one year.. (some longer)

May 3rd - Send to Lockbox Chicago

April 1st - Email notifications received (12:20am)

It rotates. If you search older threads you will see that all services centers get backlogged after a while. Some more than others but none are immune.

Check the USCIS Ombudsman 2016 Annual Report (published 6/29/19). https://www.dhs.gov/sites/default/files/publications/DHS%20Annual%20Report%202016.pdf Section on I-751 starts on Page 76. Though the Ombudsman acknowledges the delays in I-751s, whatever data they are using doesn't reflect the current processing times. They say average processing time for VSC is 7 months. Haha! Btw, Ombudsman wants adjudication within year of receipt. So even in its current state VSC is borderline slow according to the Ombudsman.

Page 5 shows the average waiting time for I-751 interviews per field offices. It is shocking some field offices have more than 1.5 years waiting. Shoot! Boston, Dallas 18 months, Queens almost 2 years. These people will first wait almost 1 year for VSC to respond, then probably another 3-4 months during RFE stage, and eventually another 1.5 years if they go to interviews. Geez! They ask USCIS to improve waiting times for interviews, here's the response: "USCIS will look into this issue and will work to ensure that Form I-751s are adjudicated in a more consistent manner."

And one last note for FBI background check related delays, Ombudsman wants USCIS to form a unified monitoring system and follow up with FBI on the status of pending cases. Let's see how they respond to that.
