Question about eligibility timeframe to apply

Timeline

My ex-wife wants to apply for US Citizenship and I am not sure if she is eligible yet, any advice would be appreciated.

We were married in March 2011 and applied for a CR-1 visa and she was approved and came here on July 5 2013, but sadly we divorced in September 2014, she has been working here and has not remarried.

She has lived here for the 3 years but not sure since we divorced if she is eligible to apply yet.

Thanks in advance for any suggestions

Timeline

No she is not eligible for citizenship under 3 years rule since she is no longer married with you. She will need to file under 5 years rule after 2 years.

Did she already have a 10 year GC?

Spouse:

2015-06-16: I-130 Sent

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

2017-08-01: Entry to US

as stated, no because she is divorced

she can only apply for the 3 year rule if she were still married to you

now she must file under the 5 year rule

Yes she got her 10 year card when she arrived in the US in July 2013.

I wondered about that on the 5 year rule, Thanks for the advice.

the only way she could apply after 3 years is if you both were still married. in other case she'll need to wait 5 years after receiving your green card
