Hi,

I'm a Filipina currently on vacation in San Francisco, CA and my US citizen boyfriend (now fiance) just proposed to me last week. I've decided to put the documents necessary for the K1 application together myself, while I'm still here, since my fiance has a full-time job and has no time to do it (but he will of course approve of everything and sign everything before we mail it out).

I am leaving to go back to the Philippines next week, but would like to mail this packet out before I leave... Do you think I should still fill out Question 15 (if fiancee is currently in the USA) of the I-129F form, even if I'm already leaving next week? I just don't want it to complicate things, since I know the fiance(e) shouldn't be in the USA and should have the interview in her/his own country of residence.

If you're legally in the US then it's fine to answer that you are here on a bonified visa. No harm in that.

You/your fiancee should fill the form with correct information applicable by the date he/she signs that form. Your information of US presence in that form will not complicate the process. What might possibly complicate it is if, during the interview, the CO sees you departed US on 22 Jun (suppose) and i129f was signed on 18 Jun but no info of your trip to US was mentioned in that section. You will be in a pretty big problem then.

I was there when I sent off our I130 and did state that. But at the bottom of the application I noted to send to NVC and then to embassy. Maybe its different for fiancee visa but I'm not sure.
