k1 visa co-sponsor

I have a concern with regards to co-sponsor since I just graduated from college in the Philippines and planning to go back to US and probably send a petition to my boyfriend. Since I do not have work and have 0 income my parents and I decided to have them as my co-sponsor. My problem is that I heard the Philippine US Embassy doesn't accept co-sponsor for k1 visa. Is there a chance I could petition my boyfriend faster?

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

you can only have one co sponsor, not both of your parents,

I have read on the forum that they do accept co sponsors, but on a case by case basis, and the odds are better if the co sponsor is a relative,

so you might have a good chance since the co sponsor would be a parent

Thank you so much aleful. But would there be a greater chance our petition would be approve? Knowing I do not have work yet. :( Because there were thread saying it's better to do the spousal visa though it would take too long as compared to the k1

Being you are currently living in the Philippines and need to use a co-sponsor I would highly suggest you get married in the Philippines then complete a Direct Consulate Filing (DCF) after you have your marriage registered at PSA. Two reasons for this: 1) DCF for a IR/CR-1 spousal visa is the fastest process for obtaining a visa (even with waiting for PSA) 2) The embassy HAS to accept a qualified co-sponsor with the IR/CR-1.

The actual DCF process takes about 60 days. So if you can expedite your marriage registration with PSA you could be done and on the way to the USA in 4-6 months TOTAL.

One option is to get married and use a DCF.

Another option is to use a K-1 petition. The U.S. Embassy Manila appears not to be asking K-1ers for their I-134 and income tax return. If that's the case, it would make a co-sponsor unnecessary.

Yes that is what Hank states. You get married, file the DCF for a IR/CR-1, submit your parents co-sponsorship (at this point your application will be adjudicated on your parent financials not yours) so there will be no requirements of employment for you and no issues if your parents exceed the poverty level. If this is all true for your case YOU PASS. Simple. Done.

Thank you so much Hank! But will I be qualified to file for a DCF knowing I don't have work here in the Philippines yet and will be back next month in the US to get my state board exam. :)

Requirement for DCF is for the USC to be living in the Philippines 6 months or more, working in the Phils is not a requirement.

Adequate income is a requirement but with the IR/CR-1 visa any qualified co-sponsor handles that issue.

You will submit an I-864 (even though you have no income), your parents will also submit an I-864 along with required supporting documents.

Nope can't file DCF if you aren't in the Phils. Too bad you are returning to the states so soon. If you got married before heading to the states you could still file the IR/CR-1 visa, this would give you the edge with a qualified co-sponsor accepted by the embassy. Just a thought..
