Timeline

I filed my AOS and EAD + PAROL on 14 November 2015, but still I haven't heard anything except a reply on enquiry 2 weeks ago that our office is busy. I am upset :( don't know what to do .. Already 6 months here I am free

During that time there have been 5 federal holidays (Thanksgiving, Christmas, New Year, MLK Day, President's Day) so work is probably backing up. It's no fun but we just have to be patient.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

It's allready 104 days I am waiting my EAD, contacted them and they replied your Application is under review and you will get your decision with 60 days. I m completely disappointed , tell me guys what does it mean and what can I do now ?

am in the same situation too....

i filed for AOS with the work permit on the 25th of November, 2015. i had boimetrics done on the 28th Dec 2015. in between, i received a NOA on the 30th of December, 2015 requesting more evidence on my birth certificate. i got a court affidavit from my parents and mailed it to them. it was received on the 14th of Jan 2016. my worry is that i still haven't gotten any update on the wok permit especially. and i have called them to say its way past 90days and i haven't heard anything. the lady said that it could be more than 90days.i need advice

I appreciate your frustration at the lack of progress. It sucks, but, there are thing that you can do once your EAD application is outside the 90 day regulated processing time are:

  • File a service request online (you've done that already - skip ahead).
  • Call the NCSC and ask to speak to a supervisor (i.e. a Tier 2 USCIS immigration officer) about your case.
  • Schedule an INFOPASS appointment at your local USCIS office to get answers in person.
  • If you get nowhere with your local office and reach Day 150, you can contact the DHS Ombudsman and request additional help with your case.
  • You can also contact your senator and/or congressperson. Mine (in CA) has a liaison for immigration cases - yours might too.

I hope that helps a little and that you get your case approved soon!

thanks for the update. i got a response from them after i submitted an inquiry.. saying that my application is still under current processing time. and that they received my additional information they requested on the 14th of Jan, that my work permit will be processed within the receipt of the additional evidence. is this suppose to be so? because what they needed additional info was for my AOS. was it suppose to affect the timeline of the EAD? both was submitted on the 25th of November, 2015. bio metrics done on the 28th of Dec, 2015, additional evidence request submitted on the 14th Jan 2015. Is anyone going through this or has been through it???

Ah, if you got an RFE on your AOS then it would have stopped the clock on your EAD on the date the RFE was issued and would not restart until USCIS received the evidence they requested from you. Sounds like you'll have to re-calculate your 90 day period to exclude the time the clock was stopped.

thanks for the quick response. for clarity, it means am still within the processing period because it took me 14days to get the additional evidence they requested. so if i recalculate it, the 90days processing time will be on the 12th of March. which is in a few days.

14 days is a pretty fast turnaround for an RFE - nice one.

Hi all, can you please help me, it's almost 110 days I am waiting for my EAD I filed with AOS. I contacted them twice firstly they said our office is busy and second time they replied your case is under review and you will get decision with in 60 days . I am so frustrated is it normal if your EAD is under review ?
