I will be filing my FIance's (living in the Philippines) K1 visa in May of this year (2016) and I am a little worried about submitting my Tax Returns. I was told, or at least I've read this in a few forums in the internet, that a sponsor would need AT LEAST 3 years of tax return. I do have tax returns since 2012, though, the only tax returns that goes above the Poverty Guidelines are my tax returns from 2014 ($24,000) and 2015 ($39,000). If they were to require all 3 tax returns, then I would also have to show my 2013 ($14,000) tax return which is not enough for the poverty guideline. And I do not have anyone to sponsor my Fiance aside from myself. Should I wait until next year then to file so I can have 3 sufficient Tax Returns? I am really worried about this.

No, if your current and continuing income meets the requirement you should be ok. No reason to have 3 years above the line.

You only need to submit the most recent tax return with the I-134. Even if you needed all 3(you will need the total income info from the last 3 years for the I-864 later), the past incomes are not what is most important. Your current annual income is what needs to meet the requirement. Along with the most recent tax return, you can provide a letter from employer and/or recent pay stubs that show what your current income is.

They will go by your current income 2015 Return and current employment verification letter and paystubs. The fact that you have showed more income for each of the three years should be a benefit. It shows your income is not only stable but increasing as time goes on. Go for it and file now to get your K-1 visa for fiancée.

Okay, so, now I am getting really confused. So, there's the I-134 and I-1864? When do they ask for the I-134 and I-864?

The I-134 is for the K-1 visa interview. The I-864 will be needed later, after you marry and need to file for AOS.

Not true. Per the embassy instructions letter you only need your most recent tax return and W2. As long as you income meet the poverty guidelines you are good to go! :thumbs:

Another thing is, I had 9 W2s from 2015 (I kinda switched from a few jobs to another last year, and I have been working 2 jobs at a time. That is why I ended up getting 9. THOUGH, I made $39,000. But is having A LOT of W2s can be viewed by the USCIS as an unstable income?

By the way, you really don't need to worry about your income looking unstable. Also, lately the U.S. Embassy Manila hasn't been asking K-1ers for the I-134, income tax return, nor W-2's. But you should definitely have it with you at the interview.
