I've noticed that most cases here are adjusting from K1 visas. I was wondering if anyone would be able to inform me if there is any difference between adjudicating a K1 visa and a Visa Waiver Program overstay?

Is there any possibility that the interview might be waived for a VWP overstay (parent of USC)?

Also, do these AOS of VWP overstay cases take longer than a K1 for instance to adjudicate?

Length of cases are all determined by different factors (mostly out of our control) where you file, officer dealing with your case etc

I recently found out that in the not too distant past the K1 route took longer but it does appear many are being approved without interview lately.

In the case of other visas expect an interview for sure bd a wait time of 6-9 months at a guess (my own opinion on length of time by the way)

. Looks like its a combo card . Coz it says advance parole too . On Monday running to Dmv .

Hope you all had a good weekend, Just wanted to give you an update on my case.

Update: My husband called USCIS on my behalf because it has been more than 75 days and still no EAD. They insisted that I had to be on the line and give my permission as the applicant or they wouldn't talk to my husband (petitioner) about the case. They had us put in a service request and said they would respond to it within 15 days. The weird part is they asked us if one of us is affiliated with the US military. My husband is. Has anyone else been asked that? I wondering why it matters to them when doing a service request if you're in the military?

February 29th, 2016: Mailed AOS package (I-485, I-765, I- 131) [Day 0]

March 1st,2016: AOS package arrived at Chicago Lockbox [Day 1]

I just got another random letter in the mail from USCIS.

It was my interview letter!!!!! I was jumping up and down. :dancing::dancing::dancing:

I had been so stressed out worrying about the RFIE's.

Now I have to assemble all the required documents.

I can't wait to be done.

I hope everything with my "expired medical" works out... I wish i just did a new medical and sent it to them rather than follow the instructions of the officer i talked to and mail a letter saying it can't be expired.. I'm hoping to intercept the package so we will see.. The tracking hasn't updated since yesterday but it is estimated to be delivered tomorrow. Whether that is to my address or uscis I do not know.

Anyway, all the best for the interview :) :)

How is that going btw? Has USCIS received your response yet?

I called tier 2 today too, to ask about my EAD card (case approved on April 26th). The lady said she's putting in a service request to get the card printed and also said I should hear something by the 28th. Hoping its sooner.

Since the EAD doesn't have a petitioner (only the I485 does), they are correct in asking for permission from your husband. Not sure about the military stuff.

So I basically freaked out and intercepted my package. I saw people say they got denied when they didn't send a new medical. The officer I spoke to the first time put in a service request for me to say I shouldn't have got that letter because my medical is not expired but at this point I don't want to risk denial. I'm at the medical office waiting for a new medical :( it really sucks. At least they dropped the price since my vaccines are less than 6 months old.

I would have understood if I had a letter saying they don't have it (because they lost it) but they said mine was expired. It's incredibly infuriating. My exam was less than 6 months ago!

Another frustrating thing is that this rfe does not show up on my case tracking. It feels like it doesn't exist in their system. It also means I won't see if they receive my new expensive medical. I'm so anxiety ridden from this entire process. I pray that this medical is the last thing they need from me.

I was asked this too and my husband is in the navy. They actually process service requests faster for military members and their families.

Sometimes it takes a little longer but usually i get a reply within 48 hours of filing the service request.

It really is annoying, but at least you'll be less stressed out about what you sent to them.

The USCIS case status website has not been updated in a while. My interview notice says May 6th, but the website still says RFE response received (April 20th). I guess they are super backlogged right now and can't keep up with the updates.
