I was added to my husband's account a few days after my arrival with only my Passport. We bank with Wells Fargo, they're decent and pretty flexible about ID's and such. Changed my name with no problems either, only needed the certified marriage license. But like others have said, try someone higher up or a different bank.

LA is governed by Napoleonic law so it differs to most other states, I can't get put on to my husband's bank account without a state ID which is really annoying as we want to have important accounts in joint names.

I have read that a GC can take a long time to come through so even if my employment auth comes through I will need to rely on walking or public transport (which is rubbish here!) as my husband travels the world for his job and can't always be there to drive me around!

Guess its just another waiting game!

We filed for AOS in early October got an RFE and received the EAD right after Christmas. Our green card was approved last week without an interview so the whole process took us less than 4 months. Hopefully it shouldn't be too long for you.

No problem with my bank. We applied even before filing for AOS. All that was needed to add him to my account was our marriage certificate, his passport/visa, I-94, and his UK license as a secondary ID to compare to the passport (but they would have also accepted an EAD if we had one or an American license). We signed a lot of forms, and there was no issue. He did not have his SSN yet, we actually went and got that the same day so it was not needed by the bank. It required the manager to do it for us. Perhaps if the OP's bank refuses their business they should go elsewhere.

So I'm answering this question from the banking perspective.

You do NOT need state ID to open a bank account.

This falls under the rules of the Patiot Act - know your Customer rules.

This is what you need:

I am not a U.S. Citizen. What can I use to open an account?

For non-U.S. citizens who do not have a SSN, one of the following numbers can be used:

  • Passport number and country of issuance.
  • Alien identification card number.
  • Number and country of issuance of any other government-issued document bearing a photograph.

I applied for a SSN but don’t have it yet. Do I have to wait to open an account?

As long as you have applied, the CIP Rule allows banks and other financial institutions to open an account. You will have to provide proof of your application. Pending applications are acceptable for both individuals and businesses.

talk to the Bank Manager and explain you know what is required under this Act and that what they are asking for is not it!

Their Bank is still in full compliance with the Patriot Act by requiring a state issued ID. The patriot act only puts forth a minimum set of standards, Banks can require more than the minimum for a person to open or be added to an account.

Do you have an EAD card or Social Security Card? We're from Ohio and had one heck of a time trying to get my husband's State ID. The people at the BMV have no idea what they're doing. It got to the point where we were going to have to bring a lawyer down with us. If you have the EAD, Social Security card, and your Passport, that is literally all you need. We found this out 3 visits to the BMV and two phone calls to a lawyer later! Don't let them make you feel bad just because they have no clue how to deal with immigration paperwork.
